{"id":131250,"date":"2010-01-13T00:00:00","date_gmt":"2010-01-12T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/ram-dev-ram-vs-state-of-u-p-others-on-13-january-2010"},"modified":"2018-10-20T17:38:49","modified_gmt":"2018-10-20T12:08:49","slug":"ram-dev-ram-vs-state-of-u-p-others-on-13-january-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/ram-dev-ram-vs-state-of-u-p-others-on-13-january-2010","title":{"rendered":"Ram Dev Ram vs State Of U.P. &amp; Others on 13 January, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Ram Dev Ram vs State Of U.P. &amp; Others on 13 January, 2010<\/div>\n<pre>Court No. - 29\n\nCase :- WRIT - A No. - 71788 of 2009\n\nPetitioner :- Ram Dev Ram\nRespondent :- State Of U.P. &amp; Others\nPetitioner Counsel :- Sri Ram Pandey\nRespondent Counsel :- C.S.C.,Sujeet Kumar Rai\n\nHon'ble Satya Poot Mehrotra,J.\n<\/pre>\n<p>Hon&#8217;ble Kashi Nath Pandey,J.\n<\/p>\n<p>      The present Writ Petition has been filed by the petitioner making the<br \/>\nfollowing prayers:-\n<\/p>\n<p>      (A) Issue a writ, order or direction in the nature of mandamus<br \/>\ncommanding the respondent no. 3 to pay the 2\/3rd salary of the petitioner<br \/>\nas subsistence allowance since July 2008 during the suspension period.\n<\/p>\n<p>        (B) Issue a writ, order or direction in the nautre of mandamus<br \/>\ncommanding the respondent no. 3 to provide the necessary documents<br \/>\nwhich demanded by the petitioner so that the proper reply of show cause<br \/>\nnotice may be immediately possible.\n<\/p>\n<p>        (C) To issue any other writ, order or direction which this Hon&#8217;ble<br \/>\nCourt may deem fit and proper under the facts and circumstances of the<br \/>\ncase, so that justice be done.\n<\/p>\n<p>        (D) To award the cost of the proceeding of the Writ Petition to the<br \/>\npetitioner.\n<\/p>\n<p>         From the averments made in the Writ Petition, it appears that the<br \/>\npetitioner while working as Branch Manager, District Cooperative Bank Ltd.,<br \/>\nBranch Rani Ganj, District Ballia was placed under suspension by the order<br \/>\ndated 15.02.2008 (Annexure 1 to the Writ Petition), and the disciplinary<br \/>\nproceedings were initiated against the petitioner. The petitioner was served<br \/>\nwith charge sheet dated 28.03.2008 (Annexure 2 to the Writ Petition). The<br \/>\npetitioner submitted his reply dated 17.04.2008 (Annexure 3 to the Writ<br \/>\nPetition) in respect of the charges levelled against him in the said charge<br \/>\nsheet.\n<\/p>\n<p>       The petitioner filed a Writ Petition being Civil Misc. Writ Petition No.<br \/>\n38813 of 2008 before this Court challenging the aforesaid order of suspension<br \/>\npassed against the petitioner. By the order dated 04.08.2008 (Annexure 4 to<br \/>\nthe Writ Petition), the said Writ Petition filed by the petitioner was dismissed<br \/>\nby this Court with the observation that the &#8220;Departmental inquiry shall be<br \/>\nconcluded very expeditiously, provided the petitioner cooperates and does not<br \/>\nseek unnecessary adjournments in the inquiry proceedings.&#8221;\n<\/p>\n<p>       It further transpires that after the said order dated 04.08.2008 passed by<br \/>\nthis Court, the Inquiry Report dated 27.08.2008 (Annexure 5 to the Writ<br \/>\nPetition) was submitted. A show-cause notice dated 10.02.2009 (Annexure 6<br \/>\nto the Writ Petition) was thereafter served on the petitioner.\n<\/p>\n<p>        It is inter-alia, averred in the Writ Petition that after receiving the said<br \/>\nshow-cause notice, the petitioner demanded several papers from the<br \/>\nrespondent no. 3. However, despite several applications, no paper has been<br \/>\nsupplied to the petitioner by the respondent no. 3.\n<\/p>\n<p>        It is inter-alia, further averred in the Writ Petition that the petitioner<br \/>\nalso made several representations to the respondent no. 3 for payment of<br \/>\nsubsistence allowance at the rate of 2\/3 of the salalry. However, nothing has<br \/>\nbeen done in the matter. Copies of the representations have been filed and<br \/>\ncollectively marked as Annexure 8 to the Writ Petition.\n<\/p>\n<p>       Thus the grievance raised by the petitioner in the present Writ Petition<br \/>\nis regarding non-payment of subsistence allowance at the rate of 2\/3 of the<br \/>\nsalary of the petitioner.\n<\/p>\n<p>       We have heard Sri D.C.Yadav holding brief for Sri Shri Ram Pandey,<br \/>\nlearned counsel for the petitioner and Sri S.K.Rai, learned counsel for the<br \/>\nrespondent nos. 2, 3 and 4. Learned Standing Counsel appearing for the<br \/>\nrespondent no. 1 has also been heard.\n<\/p>\n<p>      Having regard to the facts and circumstances narrated above and having<br \/>\nconsidered the submissions made by the learned counsel for the parties, we<br \/>\nare of the opinion that the interest of justice would be subserved in case the<br \/>\nWrit Petition is disposed of permitting the petitioner to make a fresh<br \/>\ncomprehensive representation before the respondent no. 2 and directing the<br \/>\nrespondent no. 2 to decide such representation within a specified period.\n<\/p>\n<p>        We accordingly dispose of the present Writ Petition with the following<br \/>\ndirections:-\n<\/p>\n<p>         1. The petitioner will make a fresh comprehensice representation<br \/>\nbefore the respondent no. 2 alongwith a certified copy of this order within five<br \/>\nweeks from today.\n<\/p>\n<p>         2.
