Therefore, his case for Helper<br \/>\nSahayak has not been considered and no appointment order has been<br \/>\nissued in favour of petitioner.  Learned advocate Mr. Acharya brought<br \/>\nto the notice of this Court the circular dated 27th<br \/>\nFebruary,2004, wherein under such circumstances, further 38 months<br \/>\nrelaxation in the upper age has been given to such candidates those<br \/>\nwho have completed training with respondent-Board.  It is necessary<br \/>\nto note that after decision dated 4th January,2010,<br \/>\npetitioner remained inactive and not make any representation to<br \/>\nrespondent for considering aforesaid circular dated 27th<br \/>\nFebruary,2004.
