Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/01\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n          CRL.M.C.No. 104    OF 2010\n          ===========================\n\n    Dated this the 22nd day of January,2010\n\n                     ORDER\n<\/pre>\n<p>    Petitioners  are  the  accused  and  second<\/p>\n<p>respondent  the   de   facto   complainant   in<\/p>\n<p>C.C.622\/2007 on the file of Judicial First<\/p>\n<p>Class Magistrate&#8217;s Court, Thaliparamba taken<\/p>\n<p>cognizance for the offence under section 498A<\/p>\n<p>read with section 34 of Indian Penal Code on<\/p>\n<p>annexure VII final report.    This petition is<\/p>\n<p>filed under section 482 of the Code of Criminal<\/p>\n<p>Procedure  to   quash   the   cognizance  taken<\/p>\n<p>contending that there is no material to prove<\/p>\n<p>the ingredients of the offence.<\/p>\n<p>    2.    Learned  counsel  appearing  for  the<\/p>\n<p>petitioners and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>    3.   On hearing the learned counsel and<\/p>\n<p>going through Annexure VII final report, I<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.104\/2010            2<\/span><\/p>\n<p>cannot agree with the submission that this court<\/p>\n<p>has to exercise the extra ordinary powers under<\/p>\n<p>section 482 of the Code of Criminal Procedure to<\/p>\n<p>quash the cognizance taken.
