Heard learned advocate for the petitioner and learned AGP<br \/>\nfor the respondents.\n<\/p>\n<p>2.\t\tThe<br \/>\npetitioner-detenue has preferred this petition under Article 226 of<br \/>\nthe Constitution of India, for appropriate writ, order or direction<br \/>\nfor quashing and setting aside the impugned order dated 27.1.2010<br \/>\npassed by the respondent No.2-Commissioner of Police, Ahmedabad City<br \/>\nin exercise of power under sub-section (1) of Section 3 of the<br \/>\nGujarat Prevention of Anti Social Activities Act, 1985 ( PASA Act<br \/>\nfor short) whereby the petitioner has been detained as a<br \/>\n bootlegger .  In pursuance of the said impugned order, the<br \/>\npetitioner is detained in Surat Jail on 28.1.2010.\n<\/p>\n<p>3.\t\tAlong<br \/>\nwith the detention order, the petitioner detenue has been supplied<br \/>\nwith the grounds of detention. From the grounds of detention, it<br \/>\nappears that two offences being Prohibition CR Nos.5523 of 2008 and<br \/>\n5703 of 2009 have been registered against the detenue.  Both the<br \/>\noffences have been registered with Sardarnagar Police Station under<br \/>\nthe provisions of Sections 66-1B, 65AE, 116-B and  81  of the Bombay<br \/>\nProhibition Act, wherein total quantity of 35 bottles foreign liquor,<br \/>\n96 tins bear and 20 ltrs. of country made liquor was found from the<br \/>\npossession of the detenue. On the basis of registration of these<br \/>\ncases, the detaining authority held that the present detenue was<br \/>\ncarrying on activities of selling liquor which is harmful to the<br \/>\nhealth of the public. It is held by the detaining authority that as<br \/>\nthe detenue is indulged in illegal activities, it is required to<br \/>\nrestrain the detenue from carrying out further illegal activities,<br \/>\ni.e. selling of liquor. The detaining authority has placed reliance<br \/>\non the above registered offences and statements of unnamed witnesses.<br \/>\n In the opinion of this Court, the activities of the detenue can, by<br \/>\nno stretch of imagination, be said to be disturbing the  public<br \/>\norder.  It is seen from the grounds of detention that a general<br \/>\nstatement that has been made by the detaining authority that<br \/>\nconsuming liquor is injurious to health.  In fact, a perusal of the<br \/>\norder passed by the detaining authority shows that the grounds which<br \/>\nare mentioned in the order are in reference to the situation of  law<br \/>\nand order  and not  public order .  Therefore, on this ground,<br \/>\nthe subjective satisfaction arrived at by the detaining authority is<br \/>\nvitiated on account of non-application of mind and the impugned<br \/>\norder, therefore, deserves to be quashed and set aside.\n<\/p>\n<p>4.\t\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling liquor which is harmful to the health of the<br \/>\npublic. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki v.<br \/>\nPolice Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having considered<br \/>\nthe decision of the Hon&#8217;ble Apex Court in the case of Ram Manohar<br \/>\nLohia v. State of Bihar (AIR 1966 SC 740), this Court held that<br \/>\nthe cases wherein the detention order passed on the basis of the<br \/>\nstatements of the witnesses falls under the maintenance of  law and<br \/>\norder  and not  public order .\n<\/p>\n<p>5.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the  public  order<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to  public order . In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\t\tThe<br \/>\npetition is allowed. The impugned order of detention dated 27.1.2010<br \/>\npassed against the detenu is hereby quashed and set aside. The detenu<br \/>\nis ordered to be set at liberty forthwith, if not required in any<br \/>\nother case. Rule is made absolute accordingly.
