CHAUHAN\n\nMr.Rajendra Kumar Sharma, for the petitioner.\nMs.Alka Bhatnagar, Public Prosecutor.\n\n\nBY THE COURT:<\/pre>\n<p>\t\tAlthough the petitioner has prayed for quashing of the FIR, FIR No.165\/2010, dated 08.06.2010, registered at Police Station Adarsh Nagar, Jaipur for offences under Sections 420, 406, 408, 409 and 120B IPC, but the learned counsel for the petitioner has made a very limited prayer before this court.\n<\/p>\n<p>\t\tMr. Rajendra Kumar Sharma, the learned counsel for the petitioner, has pleaded that when the Police had asked the petitioner to identify her signatures on the withdrawal slips, she had clearly told the Police that the signatures are not hers. However, instead of getting the signatures verified and examined by Forensic Science Laboratory, the Police had arrested the petitioner. Meanwhile, the petitioner has gotten the signatures examined privately by the Former Additional Director, Rajasthan Police, Forensic Science Laboratory. The Former Director, in his report, has clearly stated that the signatures are not that of the petitioner. According to the petitioner, she has submitted the said report to the Investigating Officer. But despite the submission of the said report, the Police is still not getting her signatures examined and verified by the FSL. Hence, the limited prayer of the learned counsel for the petitioner that the I.O. be directed to send the withdrawal slips for examination of the FSL and a report should be sought from the FSL as to the veracity and authenticity of the petitioner&#8217;s signature thereupon. He has further pleaded that since the petitioner happens to be a widow lady, who needs to look after her children, the FSL be directed to expedite and to give its report within a period of one week.\n<\/p>\n<p>\t\tOn the other hand, Ms. Alka Bhatnagar, the learned Public Prosecutor, has contended that one week&#8217;s time may be too short for the FSL to give its report. However, the learned Public Prosecutor has conceded, and in the opinion of this Court, fairly so, that the Investigating Agency is required to carry out an impartial and a fair investigation.\n<\/p>\n<p>\t\tHeard the learned counsel for the parties.\n<\/p>\n<p>\t\tConsidering the fact that the petitioner has placed a report of a handwriting expert and considering the fact the I.O. is legally bound to carry out a fair investigation, this Court directs the I.O. of FIR No.165\/2010, dated 08.06.2010, registered at Police Station Adarsh Nagar, Jaipur for offences under Sections 420, 406 408, 409 and 120B IPC, to immediately send the documents in dispute to the FSL for its examination and report. The FSL is directed to give its report within a period of ten days from the date of receipt of the documents in dispute. Upon receiving the report of the FSL, the I.O. shall decide the course of investigation and shall consider whether the charge-sheet should be submitted against the petitioner or not ?\n<\/p>\n<p>\t\tWith these directions, this petition is, hereby, disposed of.\n<\/p>\n<p>(R.S.
