Kuriakose, J<\/p>\n<p>      The Requisitioning Authority is in appeal.<\/p>\n<p>The case pertains to acquisition of land in Tholoor<\/p>\n<p>village of Thrissur district for the purposes of<\/p>\n<p>construction of 33 KV sub-station at Parappur. The<\/p>\n<p>land was dry land. The acquisition was pursuant to<\/p>\n<p>Section 4(1) notification published on 15\/02\/2000.<\/p>\n<p>The Land Acquisition Officer fixed land value at<\/p>\n<p>the rate of Rs.10,588\/- per Are. This was done on<\/p>\n<p>the basis of the basis document. Before the<\/p>\n<p>Reference Court, the evidence consisted of<\/p>\n<p>Exts.A1 to A3, the oral evidence of AWs.1 and 2<\/p>\n<p><span class=\"hidden_text\">L. A. A. Nos.1386 &amp; 1388 of 2009  -2-<\/span><\/p>\n<p>       on the side of the claimants. AW2 was an<\/p>\n<p>       Advocate Commissioner who submitted Ext.X1<\/p>\n<p>       report. The solitary items of counter evidence on<\/p>\n<p>       the side of the Government and the Requisitioning<\/p>\n<p>       Authority was Ext.R1 certified copy of the basis<\/p>\n<p>       document.         Even    though  the    Advocate<\/p>\n<p>       Commissioner in Ext.X1 had recommended for<\/p>\n<p>       award of much higher value, the learned<\/p>\n<p>       Subordinate Judge did not become inclined to<\/p>\n<p>       accept such re-commendations. What the learned<\/p>\n<p>       Judge ultimately did was to rely on Ext.R1 basis<\/p>\n<p>       document itself noticing that there was passage of<\/p>\n<p>       two and a half years after Ext.R1 till date of<\/p>\n<p>       promulgation of Section 4(1) notification and re-<\/p>\n<p><span class=\"hidden_text\">L. A. A. Nos.1386 &amp; 1388 of 2009  -3-<\/span><\/p>\n<p>       fix the value at Rs.14,353.30\/- per Are, thus<\/p>\n<p>       awarding an enhancement of roughly 23% over<\/p>\n<p>       what was awarded.\n<\/p>\n<p>              2. Several attractive grounds have been<\/p>\n<p>       raised in this appeal by the Requisitioning<\/p>\n<p>       Authority and the learned Standing Counsel for<\/p>\n<p>       the Requisitioning Authority has addressed very<\/p>\n<p>       strenuous and persuasive arguments based on<\/p>\n<p>       those grounds. The learned counsel submitted<\/p>\n<p>       that what the court below has done is to give<\/p>\n<p>       additions at the rate of 10% per year for passage<\/p>\n<p>       of time between the date of Ext.R1 and date of<\/p>\n<p>       Section 4(1) notification. According to the learned<\/p>\n<p>       Judge, Tholoor village was a rural area and<\/p>\n<p><span class=\"hidden_text\">L. A. A. Nos.1386 &amp; 1388 of 2009   -4-<\/span><\/p>\n<p>       additions per year at that rate is not at all<\/p>\n<p>       justified. The persuasiveness of the submission of<\/p>\n<p>       the     learned     counsel  notwithstanding  having<\/p>\n<p>       scanned the impugned judgment we find that<\/p>\n<p>       neither the appellant nor the Government can<\/p>\n<p>       have      any     legitimate   grievance  about the<\/p>\n<p>       impugned judgment. Significantly neither the<\/p>\n<p>       appellant nor the Government adduced even<\/p>\n<p>       formal oral counter evidence to the evidence<\/p>\n<p>       adduced on the side of the claimants. We are sure<\/p>\n<p>       that the rate of Rs.14,353.30\/- per Are presently<\/p>\n<p>       fixed under the impugned judgment is not more<\/p>\n<p>       than the market value of the property at the<\/p>\n<p>       relevant time. Giving liberty to the appellant to<\/p>\n<p><span class=\"hidden_text\">L. A. A. Nos.1386 &amp; 1388 of 2009  -5-<\/span><\/p>\n<p>       resist the appeals, if any, preferred by the<\/p>\n<p>       claimants on the various grounds raised in this<\/p>\n<p>       appeal, we dismiss these appeals in limine.<\/p>\n<p>                                      PIUS C.
