NANAVATI &amp; NANAVATI for Respondent No. 3\n     --------------------------------------------------------------\n\n\n                CORAM : HON'BLE MR.JUSTICE RAVI R.TRIPATHI\n\n\n      Date of Order: 01\/02\/2005\n\n\nORAL ORDER<\/pre>\n<p>     1.Leave to implead the respective colleges as party<br \/>\n     respondents.\n<\/p>\n<p>     2.On 5th May, 2003, this Court issued Notice,<br \/>\n     returnable on 16th June, 2003. Till date, the Government<br \/>\n     has not chosen to file reply affidavit to the petition.\n<\/p>\n<p>     3.Mr.J.A.Adeshra, learned Advocate appearing for<br \/>\n     the   petitioners,   submitted   that   in   an   earlier<br \/>\n     proceedings, being Special Civil Application Nos.8021 and<br \/>\n     8023 of 1998, this Court had issued the following<br \/>\n     directions:\n<\/p>\n<p>      &#8220;(1)The   Government    will   constitute    a<br \/>\n             Committee   consisting    (1)   Secretary Finance<br \/>\n             Department, (2) Secretary Legal Department, (3)<br \/>\n             Secretary     Education    Department    and  (4)<br \/>\n             Vice-Chancellor of relevant Universities and that<br \/>\n             Committee will consider the contents of the<br \/>\n             [petitioner which has been raised in the petition<br \/>\n             and entire record of the petition will be treated<br \/>\n             as representation of the petitioner. Over and<br \/>\n             above if petitioner desire to file additional<br \/>\n             submission then it will be open for her to file<br \/>\n             written submission within two weeks from the date<br \/>\n             of receipt of the writ of this Court.\n<\/p>\n<p>      (2)After     the   Committee   received   such<br \/>\n           representation, the Committee will afford an<br \/>\n          opportunity of hearing to the petitioner and<br \/>\n          after hearing the petitioner the Committee will<br \/>\n          adjudicate the demand of the petitioner and the<br \/>\n          Committee will consider including the copy of the<br \/>\n          writ petition and the contentions raised there in<br \/>\n          and all the papers which have been submitted<br \/>\n          including the judgment of the tribunal which has<br \/>\n          been referred by the petitioner in this behalf.\n<\/p>\n<p> (2.A)The Committee will    also   afford   an<br \/>\n        opportunity of being heard to association of the<br \/>\n        teachers.\n<\/p>\n<p> (3)The    Committee will pass a short but<br \/>\n          speaking order in this behalf within four weeks<br \/>\n          from the date of receipt of said representation.\n<\/p>\n<p> (4)The petitioner will make representation<br \/>\n        by 31st December, 2001, and the Committee will<br \/>\n        decide the said representation preferably by 28th<br \/>\n        February, 2002.&#8221;\n<\/p>\n<p>Mr.Adeshra submitted that though it was directed<br \/>\nthat the High Power Committee shall        consider   the<br \/>\nrepresentation, filed by the petitioner within two weeks<br \/>\nfrom the date of receipt of the writ of this Court by<br \/>\npassing a speaking order within four weeks from the date<br \/>\nof receipt of the said representation, nothing was heard<br \/>\nand, therefore, the petitioners were constrained to file<br \/>\nMiscellaneous Civil Application No.2390 of 2002 and 1616<br \/>\nof 2002 in Special Civil Application No.8026 of 1998 for<br \/>\ncontempt. The Governemnt of Gujarat then passed an order<br \/>\ndated 25th February, 2003, a copy of which is produced at<br \/>\nAnnexure-F wherein it is stated that the Committee has<br \/>\ntaken into consideration all the relevant materials<br \/>\nsubmitted and the oral submissions made before the<br \/>\nCommittee, and decided that the request of the applicants<br \/>\nto consider the persons working of Computer Programmer in<br \/>\nthe Non-Government Affiliated Colleges, in the category<br \/>\nof the teaching staff, is not acceptable. The Committee<br \/>\nhas further decided that since the representation of the<br \/>\napplicants for revision of pay with effect from 1.1.1996<br \/>\nhas   already   been   considered by the Pay Anomally<br \/>\nCommittee, which has submitted its report        to   the<br \/>\nGovernment and the decision of the Government thereon is<br \/>\nawaited, it would not be appropriate for the Committee to<br \/>\nmake any recommendation at this stage.\n<\/p>\n<p>4.On receipt of this order dated 25th February,<br \/>\n2003, the petitioners are again constrained to approach<br \/>\n this Court by way of this petition.\n<\/p>\n<p>5.In view of the fact that the Government has not<br \/>\nfiled any reply affidavit to the petition, despite the<br \/>\nfact that Notice was made returnable on 16th June, 2003,<br \/>\nthe following order is passed:\n<\/p>\n<p>Rule and Notice as to interim relief,   returnable<br \/>\non 3rd March, 2005.\n<\/p>\n<p>In the meantime, ad interim reliefs in terms of<br \/>\nparagraph-28(E).\n<\/p>\n<p>Direct Service is permitted.\n<\/p>\n<p>(Ravi R.
