PUBLIC PROSECUTOR\nfor Respondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 22\/11\/2010\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\n\tapplication is filed by the applicants under Section 439 of the<br \/>\n\tCriminal Procedure Code, 1973 for releasing them on regular bail in<br \/>\n\tconnection with CR No.I-40 of 2010 registered with Adhoi Police<br \/>\n\tStation for the offences punishable under Sections 363, 366 and 376<br \/>\n\tof the Indian Penal Code.\n<\/p>\n<p>\tHeard<br \/>\n\tMr.Nikhil Kariel, learned counsel for the applicants and Mr.H.H.<br \/>\n\tParikh, learned Additional Public Prosecutor for the State.\n<\/p>\n<p>\tMr.Kariel,<br \/>\n\tlearned counsel for the applicants, has submitted that the<br \/>\n\tapplicants are innocent and are falsely involved in the present<br \/>\n\tcase. He has also contended that the applicants have not committed<br \/>\n\tany offence as alleged in the F.I.R. He has also contended that the<br \/>\n\tcomplaint is filed at a later stage. He, therefore, contended that<br \/>\n\tlooking to the overall facts and circumstances of the case, this is<br \/>\n\ta fit case  to release the applicants on regular bail.\n<\/p>\n<p>\tAs<br \/>\n\tagainst this, Mr.Parikh, learned Additional Public Prosecutor, has<br \/>\n\tstrongly opposed the present application and contended that<br \/>\n\tprima-facie case is made out against the present applicants. He,<br \/>\n\ttherefore, contended that present application deserves to be<br \/>\n\trejected.\n<\/p>\n<p>\tI<br \/>\n\thave gone through the order passed by the trial Court as well as<br \/>\n\tpapers produced on record of the case. Looking to the allegations<br \/>\n\tlevelled against the applicants, I am inclined to release them on<br \/>\n\tregular bail. However, learned counsel for the parties do not press<br \/>\n\tfor reasoned order.\n<\/p>\n<p>\tConsidering<br \/>\n\tthe submissions made on behalf of the parties and having regard to<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand applicants are ordered to be released on bail in connection with<br \/>\n\tCR No.I-40 of 2010 registered with Adhoi Police Station for the<br \/>\n\toffences alleged against them in this application on their executing<br \/>\n\tbond of Rs.10,000\/- (Rupees Ten Thousand Only) each with one solvent<br \/>\n\tsurety of the like amount to the satisfaction of the lower Court and<br \/>\n\tsubject to the conditions that they shall,<\/p>\n<p>(i)\tnot<br \/>\ntake undue advantage of their liberty or\tabuse their liberty;\n<\/p>\n<p>(ii)\tnot<br \/>\nact in a manner injurious to the\tprosecution;\n<\/p>\n<p>(iii)<br \/>\n \tnot leave the local limits of State of\tGujarat without the prior<br \/>\npermission of the\tconcerned Sessions Judge;\n<\/p>\n<p>(iv)\tfurnish<br \/>\nthe present address of residence to \tthe Investigating Officer as<br \/>\nwell as to the \tCourt at the time of furnishing bond and shall \tnot<br \/>\nchange their residence till further orders;\n<\/p>\n<p>(v)\tSurrender<br \/>\ntheir passport, if any, to the lower\tCourt within a week;\n<\/p>\n<p>(vi)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>\tThe<br \/>\n\tAuthority will release the applicants only if they are not required<br \/>\n\tin connection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbond to be executed before the lower Court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>\tAt<br \/>\n\tthe trial, the trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicants on bail. Rule is<br \/>\n\tmade absolute to the aforesaid extent.\n<\/p>\n<p>Direct<br \/>\n\t\t\t\tService is permitted.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
