Gandhi learned advocate appearing for the<br \/>\napplicant-appellant and Mr. Yadav learned advocate appearing for the<br \/>\nOfficial Liquidator.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Gandhi learned counsel appearing for the applicant-appellant, mainly<br \/>\npressed the interim relief against the direction issued by the<br \/>\nlearned Company Judge to enforce the recovery of Rs. 46 lacs from the<br \/>\npartners of M\/s. Mahalaxmi Builders.\n<\/p>\n<p>4.\tIt<br \/>\nappears that earlier an undertaking was already given and based on<br \/>\nthe  said undertaking, the learned Company Judge has directed for<br \/>\nrecovery of the aforesaid amount. Once an undertaking is given and if<br \/>\nthe matter is considered on the principle of equity, then also, the<br \/>\napplicant-appellant would not be entitled for the interim injunction<br \/>\nagainst the operation of the said direction, in any case, without<br \/>\ndeposit of the amount as was already undertaken.\n<\/p>\n<p>5.\tApart<br \/>\nfrom the above, the direction is in the nature of monetary liability<br \/>\nand cannot be termed as irreparable injury, and normally, in a case<br \/>\nwhere the appellate powers are to be exercised unless very very<br \/>\nextra-ordinary circumstances are demonstrated before this Court, even<br \/>\nif the matter is to be considered for grant of stay, the amount is<br \/>\nrequired to be deposited.\n<\/p>\n<p>6.\tHence,<br \/>\nthere shall be ad interim relief against the execution and<br \/>\nimplementation of the directions issued by the learned Company Judge<br \/>\nin the impugned order to  recover  the amount of Rs. 46 lacs from the<br \/>\npartners of M\/s. Mahalaxmi Builders &#8211; applicant herein, on<br \/>\ncondition that the amount of  Rs. 46 lacs is deposited by the<br \/>\napplicant-appellant with this Court within a period of four weeks<br \/>\nfrom today.\n<\/p>\n<p>7.\tIt<br \/>\nis also observed that if there is failure to comply with the<br \/>\naforesaid direction, the aforesaid ad interim relief granted shall<br \/>\nautomatically stands vacated and the consequences in law would<br \/>\nfollow.\n<\/p>\n<p>8.\tThe<br \/>\nother reliefs as prayed for by the applicant-appellant, for disposal<br \/>\nof the property etc., are even otherwise also observed by the learned<br \/>\nCompany Judge in the impugned order, but the insistence on the  part<br \/>\nof the applicant is first to resort to the implementation of the said<br \/>\ndirection and thereafter to insist for recovery of the amount of Rs.<br \/>\n46 lacs, considering the facts and circumstances and more<br \/>\nparticularly, on the ground of alleged fraud having been found by the<br \/>\nlearned Company Judge, does not deserve to be accepted.
