Justice M.SASIDHARAN NAMBIAR\n\n Dated :03\/03\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n           ------------------------------------------\n           CRL.M.C.NO.3672 OF 2010\n           ------------------------------------------\n            Dated 3rd           March 2010\n\n                         O R D E R\n<\/pre>\n<p>          Petitioners               are the accused and<\/p>\n<p>first respondent, the de facto complainant<\/p>\n<p>in C.C.479\/2009 on the file of Judicial<\/p>\n<p>First Class Magistrate, Kunnamangalam taken<\/p>\n<p>cognizance for the offences under Sections<\/p>\n<p>406 and 498 A read with Section 34 of<\/p>\n<p>Indian  Penal      Code         on       Annexure-3       final<\/p>\n<p>report. Annexure-1 complaint was filed by<\/p>\n<p>the first respondent wife alleging that<\/p>\n<p>first   petitioner            husband               and  second<\/p>\n<p>petitioner mother-in-law treated                       her with<\/p>\n<p>cruelty and also committed breach of trust<\/p>\n<p>and thereby committed the offences under<\/p>\n<p>Sections 406 and 498 A of Indian Penal Code<\/p>\n<p>before   the       Commissioner                    of   Police,<\/p>\n<p>Kozhikode based on which crime No.267\/2008<\/p>\n<p><span class=\"hidden_text\">Crmc 3672\/09               2<\/span><\/p>\n<p>was    registered.    Annexure-3  final report  was<\/p>\n<p>filed after investigation by the Sub Inspector<\/p>\n<p>of Police, Medical College Police Station which<\/p>\n<p>was taken cognizance by the learned Magistrate.<\/p>\n<p>Petition is filed under Section 482 of Code of<\/p>\n<p>Criminal      Procedure  to  quash  the  cognizance<\/p>\n<p>taken and the proceedings pending before the<\/p>\n<p>Magistrate contending that entire matrimonial<\/p>\n<p>disputes      were amicably settled.<\/p>\n<p>            2. First respondent appeared  through a<\/p>\n<p>counsel      and  filed  Crl.M.A.6281\/2009  jointly<\/p>\n<p>with      the   petitioners  stating   that  entire<\/p>\n<p>matrimonial disputes were amicably settled and<\/p>\n<p>in view of the settlement, it is not in the<\/p>\n<p>interest of justice to continue the prosecution<\/p>\n<p>and hence the case is to be allowed to be<\/p>\n<p>compounded.\n<\/p>\n<p>            3. Learned counsel appearing for the<\/p>\n<p>petitioner, first respondent and learned Public<\/p>\n<p>Prosecutor were heard.\n<\/p>\n<p><span class=\"hidden_text\">Crmc 3672\/09               3<\/span><\/p>\n<p>            4. Though an offence under       Section<\/p>\n<p>498     A    of   Indian  Penal   Code   cannot  be<\/p>\n<p>compounded,      as  held  by  the  Apex  court  in<\/p>\n<p>B.S.Joshi      and others   v. State of Haryana and<\/p>\n<p>another      (2003(4)  SCC   675)  when  there   was<\/p>\n<p>amicable       settlement    of   the    matrimonial<\/p>\n<p>disputes, it is not in the interest of justice<\/p>\n<p>to continue the prosecution. Joint statement<\/p>\n<p>filed      by  first  respondent  wife  with    the<\/p>\n<p>petitioners establishes that entire matrimonial<\/p>\n<p>disputes were settled. In such circumstances,<\/p>\n<p>it    is    not  in  the  interest  of  justice  to<\/p>\n<p>continue the prosecution.\n<\/p>\n<p>            Petition is allowed.
