Justice K.T.SANKARAN\n\n Dated :06\/07\/2009\n\n O R D E R\n                            K.T.SANKARAN, J.\n               ------------------------------------------------------\n                        B.A. NO. 3647 OF 2009\n               ------------------------------------------------------\n                     Dated this the 6th July, 2009\n\n\n                                 O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the Code of<\/p>\n<p>Criminal Procedure. The petitioner is the accused in C.R. No.47 of 2009<\/p>\n<p>of Kottarakkara Excise Range.\n<\/p>\n<\/p>\n<p>       2. The offence alleged against the petitioner is under Section 55(i)<\/p>\n<p>of the Abkari Act.\n<\/p>\n<\/p>\n<p>       3. The prosecution case is that on 13.6.2009, the petitioner was<\/p>\n<p>found in possession of 3.8 litres of Indian made foreign liquor and 10.5<\/p>\n<p>litres of Asavam (medicinal preparation) in his stationery shop in<\/p>\n<p>contravention of the provisions of the Abkari Act.             The petitioner was<\/p>\n<p>arrested on 13.6.2009 and he is in judicial custody.<\/p>\n<p>       4. Taking into account the facts and circumstances of the case, the<\/p>\n<p>duration of the judicial custody undergone by the petitioner, the nature of<\/p>\n<p>the offence and the present stage of investigation, I am of the view that<\/p>\n<p>bail can be granted to the petitioner.\n<\/p>\n<p>B.A. NO. 3647 OF 2009<\/p>\n<p>                                          :: 2 ::\n<\/p>\n<p>       5. The petitioner shall be released on bail on his executing bond<\/p>\n<p>for Rs.25,000\/- with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the Judicial Magistrate of the First Class &#8211; I, Kottarakkara,<\/p>\n<p>subject to the following conditions:\n<\/p>\n<\/p>\n<blockquote><p>       a)     The petitioner shall report before the investigating officer<br \/>\n              between 9 A.M. and 11 A.M. on all Mondays, till the final<br \/>\n              report is filed or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>       b)     The petitioner shall appear before the investigating officer for<br \/>\n              interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote><p>       c)     The petitioner shall not try to influence the prosecution<br \/>\n              witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote><p>       d)     The petitioner shall not commit any offence or indulge in any<br \/>\n              prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote><p>       e)     In case of breach of any of the conditions mentioned above,<br \/>\n              the bail shall be liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>       The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                                        (K.T.SANKARAN)<br \/>\n                                                                Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Muraleedharan Pillai vs State Of Kerala Represented By The on 6 July, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3647 of 2009() 1.
