Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/12\/2010\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.5031 of 2010\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p>    Petitioners are the accused and second respondent,<\/p>\n<p>the defacto complainant in C.C.No.428\/2009 on the file<\/p>\n<p>of Judicial First Class Magistrate&#8217;s Court, Vadakara,<\/p>\n<p>taken cognizance for the offence under Section 498A of<\/p>\n<p>Indian Penal Code on Annexure-1 final report. This<\/p>\n<p>petition is filed under Section 482 of Code of Criminal<\/p>\n<p>Procedure to quash the proceedings contending that<\/p>\n<p>entire matrimonial disputes were settled amicably and<\/p>\n<p>consequent to the settlement, it is not in the interest<\/p>\n<p>of justice to continue the prosecution.<\/p>\n<p>    2. Second respondent appeared through a counsel<\/p>\n<p>and filed an affidavit stating that entire matrimonial<\/p>\n<p>disputes   were   settled   amicably   and   therefore,<\/p>\n<p>permission is to be granted to compound the offence.<\/p>\n<p>    3. Learned counsel appearing for the petitioners,<\/p>\n<p>second respondent and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>    4. An offence under Section 498A of Indian Penal<\/p>\n<p>Code is not compoundable. Hence, permission cannot be<\/p>\n<p><span class=\"hidden_text\">CRMC 5031\/10               2<\/span><\/p>\n<p>granted to compound the offence. But, as held by the<\/p>\n<p>Apex Court in B.S.Joshi v. State of Haryana ((2003) 4<\/p>\n<p>SCC 675), when the matrimonial disputes are settled<\/p>\n<p>amicably, it is not in the interest of justice to stand<\/p>\n<p>on technicalities and continue the prosecution. The<\/p>\n<p>affidavit filed by the second respondent establishes<\/p>\n<p>that she has settled all the matrimonial disputes with<\/p>\n<p>the petitioners. In such circumstances, it is not in<\/p>\n<p>the interest of justice to continue the prosecution.<\/p>\n<p>     Petition is allowed.
