ORAL JUDGEMENT<\/p>\n
     The Special Civil Application No. 4755\/95
\n     has been filed by residents of village        Vanod  in
\n     Surendranagar District, for a direction on the District
\n     Development Officer and the Taluka Development Officer,
\n     the respondents Nos. 2 and 3 therein, to take action
\n     against the respondent No.4 – Gram Panchayat, for not
\n     shifting the Panchayat Office to the new premises. In
\n     the alternative, it is prayed that the Panchayat should
\n     be superseded.\n<\/p>\n
     The Special Civil Application No.     5715\/95 is
\n     also filed by some residents of the same village and they
\n     seek a direction on the respondent authorities and the
\n     said Gram Panchayat that the construction put up on the
\n     land for its use as Panchayat office should be demolished
\n     on the ground that the land which was ear-marked as
\n     “zhok” land in which the petitioners were entitled to
\n     keep their cattle at night, was used for construction.\n<\/p>\n
     Earlier, the controversy as regards the shifting
\n     of the Panchayat office to the new building had surfaced
\n     in Special C.A No. 2388\/95. In that matter, the said
\n     Panchayat    had approached the High Court seeking a
\n     direction for taking action against the authorities for
\n     removing the record and other things belonging to the
\n     Panchayat to the new office forcibly at middle of the
\n     night.    That controversy was amicably resolved and the
\n     Panchayat agreed to occupy the new building         while
\n     retaining its old building and by the Panchayat taking up
\n     the stand that both the buildings will be used by it.\n<\/p>\n
     The Panchayat has taken up a stand that both the
\n     buildings are being used by it. This stand is reflected
\n     in the affidavit in reply filed by the Panchayat in
\n     Special C.A No. 4755\/95, in which it has been stated in
\n     paragraph 9 that the Panchayat is using both          the
\n     buildings – namely the existing Panchayat office building
\n     as well as the newly constructed building. If at all the
\n     Panchayat is not using any building, then it will be for
\n     the concerned authorities to look into the matter in
\n     accordance with law and the petitioners of Special C.A
\n     No. 4755\/95 can have no say in the matter.          These
\n     petitioners cannot insist about the place from where the
\n     Panchayat should run its office and none of the rights of
\n     these petitioners are affected in any manner by the
\n Panchayat functioning from its office in one building or
\nthe other. Under the earlier arrangement, it was open
\nfor the Panchayat to use both the buildings and the
\npetitioners have no locus standi to seek a direction that
\nthe Panchayat should function from any particular place.
\nThe petitioners of Special Civil Application No. 4755\/95
\nare therefore, not entitled to any relief as prayed for
\nby them and that petition is liable to be rejected.\n<\/p>\n
As   regards   Special   Civil   Application No.
\n5715\/95, it is clear that the alleged rights of the
\npetitioners to use any particular land as “zhok” land
\ninvolve several questions of facts, which cannot be
\ninvestigated in the writ jurisdiction of this Court.
\nThese petitioners do not appear to have taken any steps
\nat the time when the new building was constructed and
\nhaving allowed that building to be constructed, they are
\nnow trying to invoke the writ jurisdiction of this Court
\nfor examining their alleged customary rights in respect
\nof the   land.    As observed above, it will not be
\nappropriate for this Court to go into those questions in
\nthis petition.   Special Civil Application No. 5715\/95
\nis, therefore, also liable to be rejected.\n<\/p>\n
Under the above     circumstances,   both   these
\npetitions are rejected.     Rule is discharged in Special
\nCivil Application No. 4755\/95 with no order as to costs.
\nInterim relief stands vacated.\n<\/p>\n
In Special Civil Application No. 5715 of 1995
\nwhich was ordered to be heard with Special      Civil
\nApplication No. 4755\/95, notice is discharged with no
\norder as to costs.\n<\/p>\n
