No.I- 7 of 2006 at Bavla Police Station.\n<\/p>\n<p>2.0\t\tThe<br \/>\napplicant had, earlier, preferred an application for bail being<br \/>\nCriminal Misc. Application No. 189 of 2006 before the learned<br \/>\nDistrict Judge, Ahmedabad (Rural) in connection with the aforesaid<br \/>\noffence which was rejected by the learned Judge. Hence, this<br \/>\napplication.\n<\/p>\n<p>3.0\t\tLearned<br \/>\nAdvocate for the applicant has submitted that the learned Judge ought<br \/>\nto have appreciated the fact that the present applicant has been<br \/>\nfalsely implicated in the case. He has further submitted that the<br \/>\nlearned Judge has committed an error in ignoring the fact that during<br \/>\nthe course of investigation, there is no direct or indirect offence<br \/>\ncome from the charge-sheet indicating role of the present applicant<br \/>\nin the alleged offence.  He has further submitted that the learned<br \/>\nJudge ought to have appreciated the fat that there is delay of about<br \/>\none day in filing the complaint of the alleged offence.\n<\/p>\n<p>4.0\t\tOn<br \/>\nthe other hand, learned A.P.P. has supported the order of the learned<br \/>\nDistrict Judge and contended that the learned Judge has passed the<br \/>\nsaid order after taking into consideration all the facts and<br \/>\ncircumstances of the present case, and hence, no case is made out<br \/>\ncalling interference of this Court.\n<\/p>\n<p>5.0\t\tHeard<br \/>\nlearned Counsel for the parties.  On a perusal of the documents on<br \/>\nrecord it appears that the present applicant had preferred a bail<br \/>\napplication before the learned District Judge, Ahmedabad (Rural) in<br \/>\nconnection with the aforesaid alleged offence. The learned Judge<br \/>\nwhile deciding the said application has observed that from the record<br \/>\nit appears that the complainant&#8217;s family has no prejudice against the<br \/>\npresent applicant and the age of the complainant is about sixteen<br \/>\nyears, and therefore, it cannot be said that she has filed a false<br \/>\ncomplaint against all the accused and has wrongly implicated the<br \/>\npresent applicant in the said offence.  As regards the contention of<br \/>\nthe learned Advocate for the applicant that there is delay of about<br \/>\none day in filing the complaint, the learned Judge has observed that<br \/>\nthe offence is of such a serious nature that it is bound to take<br \/>\ntime, and hence, the same cannot be said to be false only on that<br \/>\nground and rejected the bail application of the present applicant.\n<\/p>\n<p>5.1\t\tIn<br \/>\nabove view of the matter, I am of the opinion that the prima-facie<br \/>\ninvolvement of the present applicant by way of helping the main<br \/>\naccused in the commission of the said offence cannot be ruled out at<br \/>\nthis stage. Hence, this application deserves to be rejected.\n<\/p>\n<p>6.0\t\tIn<br \/>\nthe result, the application stands rejected.
