Ltd., reported in 2006 [1] STR 291 [Tri. Bang]?\n<\/p>\n<p>2.\tWhether,<br \/>\nin the facts and circumstances of the case, the Tribunal is justified<br \/>\nand has committed substantial error of law in holding that the<br \/>\nservice rendered for the purpose of repair and maintenance would not<br \/>\nfall within the ambit of consulting engineering services as defined<br \/>\nunder Section 65 of the Finance Act, 1994?\n<\/p>\n<p>3.\tWhether,<br \/>\nin the facts and circumstances of the case, the Tribunal is justified<br \/>\nand has committed substantial error of law in construing the<br \/>\nprovisions of Rule 2[d][iv] of the Service Tax Rules, 1994<br \/>\n(introduced vide Notification No. 12\/02-St dated 1.8.2002 with effect<br \/>\nfrom 16.8.2002 rendering the person receiving taxable service in<br \/>\nIndia liable to levy and payment of service tax when taxable service<br \/>\nis provided by Non-Resident and\/or is from outside India and does not<br \/>\nhave any office in India?\n<\/p>\n<p>\tHeard<br \/>\nMr. R.J. Oza, the learned Sr. Standing Counsel appearing for the<br \/>\nRevenue and perused the orders passed by the authorities below.\n<\/p>\n<p>\tThe<br \/>\nTribunal, while disposing of the appeal, has observed that services<br \/>\nreceived by the appellant is for the purpose of repair and<br \/>\nmaintenance and the same cannot be considered as that of consulting<br \/>\nengineering services.  The transfer of technical know-how also would<br \/>\nnot come within the ambit of consulting engineering services as held<br \/>\nby the Tribunal in the case of CCE, Calicut\/Cochin vs. Rubco Sales<br \/>\nInternational P. Ltd., 2006(1) STR 291 (Tri. Bang.).\n<\/p>\n<p>\tAfter<br \/>\nthe aforesaid decision, the larger Bench of the Tribunal in the case<br \/>\nof Hindustan Zinc Ltd. v. Commissioner of Central Excise, Jaipur,<br \/>\n2008(11) STR 338 (Tri. &#8211; LB) has endorsed the view taken by the<br \/>\nTribunal.  Even recently, the Ahmedabad Tribunal has also taken the<br \/>\nsame view in the case of <a href=\"\/doc\/448079\/\">Commissioner of Service Tax, Ahmedabad v.<br \/>\nAshima Ltd.,<\/a> 2010(1&amp; STR 257 (Tri. Ahmd.). Since the matter<br \/>\nis now concluded, we do not see any justification to formulate the<br \/>\nabove questions as substantial questions of law.\n<\/p>\n<p>\tThis<br \/>\nTax Appeal is accordingly dismissed.\n<\/p>\n<p>(K.A.\n<\/p>\n<p>Puj, J.)<\/p>\n<p>(Rajesh<br \/>\nH.
