No.32483 of 2011\n                  Dhananjay Kumar Sinha son of late Shashi Bhushan Sinha\n                                         Versus\n                                   The State Of Bihar\n                                       -----------\n<\/pre>\n<p>2\/   29.09.2011                      Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                     The petitioner seeks bail in a case instituted for the<\/p>\n<p>                        offence under sections 406 and 420 of the Indian Penal Code.<\/p>\n<p>                                     It has been submitted that the petitioner is ready to<\/p>\n<p>                        refund rupees twenty thousand to the informant for the purposes of<\/p>\n<p>                        bail without prejudice to his case.\n<\/p>\n<p>                                     In view of such, let the petitioner, above named, be<\/p>\n<p>                        released on provisional bail for a period of two months on furnishing<\/p>\n<p>                        bail bond of Rs.5,000\/- (five thousand) with two sureties of the like<\/p>\n<p>                        amount each or any other surety to be fixed by the court below to<\/p>\n<p>                        the satisfaction of the Chief Judicial Magistrate, Banka, in<\/p>\n<p>                        connection with Banka P.S. Case No.01 of 2009, subject to the<\/p>\n<p>                        conditions (i) That one of the bailors will be a close relative of the<\/p>\n<p>                        petitioner, who will give an affidavit giving genealogy as to how he<\/p>\n<p>                        is related with the petitioner. The bailors will undertake to furnish<\/p>\n<p>                        information to the court about any change in the address of the<\/p>\n<p>                        petitioner, (ii) That the affidavit shall clearly state that the petitioner<\/p>\n<p>                        is not an accused in any other case and, if he is, he shall not be<\/p>\n<p>                        released on bail, (iii) That the bailors shall also state on affidavit<\/p>\n<p>                        that they will inform the court concerned if the petitioner is<\/p>\n<p>                        implicated in any other case of similar nature after his release in the<\/p>\n<p>                        present case and thereafter the court below will be at liberty to<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>       initiate the proceeding for cancellation of bail on the ground of<\/p>\n<p>       misuse, (iv) That the petitioner will give an undertaking that he will<\/p>\n<p>       receive the police papers on the given date and be present on date<\/p>\n<p>       fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>       delays the trial in any manner, his bail will be liable to be cancelled<\/p>\n<p>       for reasons of misuse, and (v) That the petitioner will be well<\/p>\n<p>       represented on each date and if he fails to do so on two consecutive<\/p>\n<p>       dates, his bail will be liable to be cancelled.\n<\/p>\n<p>                   During the period of provisional bail, the petitioner shall<\/p>\n<p>       refund rupees twenty thousand to the informant and if the proof of<\/p>\n<p>       the same having been done by the petitioner is filed in the court<\/p>\n<p>       below, his provisional bail shall be confirmed.\n<\/p>\n<\/p>\n<pre>JA\/-                                             (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Dhananjay Kumar Sinha vs The State Of Bihar on 29 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
