We have  also considered  the<br \/>\n Records &amp; Proceedings and heard the learned APP for the State<br \/>\nand Ms. Megha Jani, learned Advocate appearing for the original<br \/>\naccused No. 1,2,  4, 5, 7 and 8.\n<\/p>\n<p>3.\t\tIt<br \/>\nappears that  the prosecution case is that the bogus  applications<br \/>\nfor subsidy were made and  the amount has been withdrawn, but  there<br \/>\nis no evidence led by the prosecution to prove that the applications<br \/>\nwere made  in the name of the persons who were either not in<br \/>\nexistence or they had not made any applications.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of  the absence of the aforesaid evidence, if the learned<br \/>\nSpecial Judge has taken  the view that the prosecution has not been<br \/>\nable to prove its case beyond reasonable doubt, the same cannot be<br \/>\nsaid to be  erroneous.\n<\/p>\n<p>5.\t\tHence<br \/>\nleave does not deserve to be granted.
