Jhaveri).  The Court passed the following<br \/>\norder:\n<\/p>\n<p> 1.\tHeard<br \/>\nMr.Jignesh Patel, learned advocate for the petitioners.\n<\/p>\n<p>2.\tRule.\n<\/p>\n<p>To be expedited. There shall be ad interim relief in terms of<br \/>\nparagraph 8(B).\n<\/p>\n<p>3.\tNotice<br \/>\nas to interim relief, returnable on 16th<br \/>\nJuly 2010.\n<\/p>\n<p>\tDirect Service is permitted.\n<\/p>\n<p>2.0\tRelief<br \/>\nprayed for in this petition is as under:\n<\/p>\n<p> 8(A)\tThis<br \/>\nHonorable Court may be pleased to issue a writ of Mandamus or any<br \/>\nother appropriate writ, order and direction declaring that to<br \/>\nquash and set aside the appointment order passed by<br \/>\nRespondents authority on 13\/10\/2009 at Annexure   I as well as the<br \/>\nsubsequent order passed on 9\/4\/2010 at Annexure   K to this<br \/>\npetition.\n<\/p>\n<p>2.1\tAd-interim<br \/>\nrelief granted by this Court on 10th May 2010 reads as<br \/>\nunder:\n<\/p>\n<p> Pending<br \/>\nthe hearing and final disposal of this petition, be pleased to stay<br \/>\nthe operation and execution of the impugned order of appointment<br \/>\ndated 13\/10\/2009 at Annexure   I as well as the subsequent order<br \/>\npassed dated 9\/4\/2010, at Annexure   K to this petition.\n<\/p>\n<p>2.2\tLearned<br \/>\nadvocate Mr. Jignesh Patel for the petitioners invited attention of<br \/>\nthe Court to Annexure &#8216;I&#8217;, which is an order dated 13th<br \/>\nOctober 2009, passed by the Dy. Secretary, Panchayat, Rural Housing<br \/>\nand Rural Development Department, whereby, the authority was pleased<br \/>\nto grant sanction under the powers available to him under Rule 20 of<br \/>\nthe Panchayat Service Classification and Recruitment Rules, 1998.<br \/>\nThe order states that,  the Government, after careful<br \/>\nconsideration, is pleased to grant permission to consider the<br \/>\nservices of the persons named in the attached schedule, 17 in<br \/>\nnumbers, working as Multipurpose Health Workers, who were appointed<br \/>\nby Sabarkantha District Panchayat on ad-hoc basis, as regular,<br \/>\nsubject to the condition mentioned in that order from the date they<br \/>\nresumed the duties, &#8216;for all purposes&#8217;.  The Conditions prescribed in<br \/>\nthe said order\/resolution are as under:\n<\/p>\n<p>(1)\tThe<br \/>\nconcerned employee must be possessing the required qualification for<br \/>\nthe post of Multipurpose Health Worker on the date of recruitment.\n<\/p>\n<p>(2)\tThe<br \/>\nperson concerned must be qualifying the age prescribed at the<br \/>\nrelevant time and the persons belonging to the reserved category must<br \/>\nbe answering to the age prescribed if they belong to that particular<br \/>\ncategory.\n<\/p>\n<p>(3)\tThe<br \/>\npersons concerned will have to pass the computer training   CCC<br \/>\ntraining\/exam from time to time within prescribed time limit.\n<\/p>\n<p>2.3\tThe<br \/>\nlearned advocate for the petitioners submitted that the<br \/>\naforesaid order\/resolution is construed to mean that these persons<br \/>\nwill steal march over the petitioners though the petitioners were<br \/>\nregularized in 1998 by order dated 15th June 1998.  He<br \/>\nsubmitted that once the petitioners were regularized in the year<br \/>\n1998, the present respondent nos. 3 to 19 could not have been<br \/>\nregularized from the date of their joining the duty and they could<br \/>\nhave been regularized only with effect from the date of order i.e.<br \/>\n13th October 2009.\n<\/p>\n<p>3.0\tThe<br \/>\nlearned advocate Mr. Goswamy for the respondent nos. 3 to 19<br \/>\nvehemently submitted that the order is just and proper and long<br \/>\nawaited justice is done to respondent nos. 3 to 19.  But then, the<br \/>\nlearned advocate for the respondent nos. 3 to 19 could not support<br \/>\nhis submission by any provision of law, which provides for granting<br \/>\nseniority with retrospective date.  In absence of any specific<br \/>\nprovision authorizing the authority to grant retrospective seniority,<br \/>\nthe order is required to be quashed and set aside to the extent it<br \/>\nconfers seniority on respondent nos. 3 to 19 with retrospective<br \/>\neffect.\n<\/p>\n<p>4.0\tWithout<br \/>\ngoing into other contentions raised in this petition and without<br \/>\ngoing into the other submissions made by the learned advocate Mr.<br \/>\nGoswamy, this petition is partly allowed and order dated<br \/>\n13th October 2009 is modified to the<br \/>\nextent that the respondent nos. 3 to 19 will get the seniority only<br \/>\nfrom the date of the order i.e. 13th October 2009.<br \/>\nFurther it is clarified that so far as the inter se seniority<br \/>\nto respondent nos. 3 to 19 is concerned, that will be on the basis of<br \/>\ntheir erstwhile seniority with the Panchayat.\n<\/p>\n<p>5.0\tRule<br \/>\nis made absolute to the aforesaid extent with no order as to costs.\n<\/p>\n<p>[<br \/>\nRavi R.
