THE BLOCK EDUCATION OFFICER, BANMANKHI, PURNEA----------\n                    -------------------------RESPONDENTS.\n                               -----------\n<\/pre>\n<p>2   10.3.2011                   Heard learned counsel for the parties.<\/p>\n<p>                                Submission of learned counsel for the petitioner is<\/p>\n<p>                that there is no rule which empowers the respondent authority to<\/p>\n<p>                effect transfer of teachers merely because they have been granted<\/p>\n<p>                promotion to B. A. trained scale. In this regard attention of the<\/p>\n<p>                Court has been drawn to the Primary Teachers Transfer Rules,<\/p>\n<p>                2006. In addition to that it is also submitted that petitioner had<\/p>\n<p>                given clear and categorical applications contained in annexures 4<\/p>\n<p>                and 7 to the District Superintendent of Education, Purnea that he is<\/p>\n<p>                willing to forgo his promotion on B.A. trained scale because he is<\/p>\n<p>                not willing to be transferred for the reasons indicated in the two<\/p>\n<p>                applications.\n<\/p>\n<p>                                Since from the counter affidavit it is evident that<\/p>\n<p>                such request has been considered with regard to certain persons,<\/p>\n<p>                there is no reason as to why the request of petitioner ought not to<\/p>\n<p>                have been considered, if he is willing to forgo his promotion to<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>      avoid transfer which is in any way not permissible under the Rule<\/p>\n<p>      as such, unless it is for the limited purpose under which such<\/p>\n<p>      transfer can be effected.\n<\/p>\n<p>                      Failure on the part of the State to point out<\/p>\n<p>      necessary rule which provides them such power, the transfer order<\/p>\n<p>      in so far as it relates to petitioner contained in annexure-5 is<\/p>\n<p>      hereby quashed.\n<\/p>\n<p>                      The District Superintendent of Education is further<\/p>\n<p>      directed to issue an appropriate order in this regard taking into<\/p>\n<p>      consideration the applications of the petitioner contained in<\/p>\n<p>      annexures 4 and 7. The Court directs that such order be issued<\/p>\n<p>      within a period of three months from the date of communication or<\/p>\n<p>      production of a copy of this order.\n<\/p>\n<p>                      This writ application is allowed with the above<\/p>\n<p>      direction.\n<\/p>\n<\/p>\n<pre>RPS                  (Ajay Kumar Tripathi,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
