THE      EXECUTIVE        ENGINEER,    HIGHWAY\n               CONSTRUCTION DEPARTMENT (NH 98), PATNA\n                                  ***********\n<\/pre>\n<p>3   20\/10\/2011             This writ application is being disposed of<\/p>\n<p>                 without any counter affidavit.\n<\/p>\n<p>                           The petitioner is aggrieved by Annexure-2 by<\/p>\n<p>                 which the Executive Engineer, Highways Construction<\/p>\n<p>                 Department, NH 98 has put a mark on the residential<\/p>\n<p>                 house of the petitioner and asked him to remove part6<\/p>\n<p>                 of the residential house.\n<\/p>\n<p>                           The case of the petitioner is that the lands are<\/p>\n<p>                 his raiyati lands and this fact has been confirmed by a<\/p>\n<p>                 degree of the competent civil court between his vendors<\/p>\n<p>                 and him in Title Appeal No. 223 of 1978.<\/p>\n<p>                           This Court has no way of knowing whether<\/p>\n<p>                 these lands have been marked for the purpose of<\/p>\n<p>                 acquisition or whether they have been marked under<\/p>\n<p>                 any other proceedings. Whatever be the reasons for<\/p>\n<p>                 marking the house of the petitioner for the purposes of<\/p>\n<p>                 removing or demolishing part of the house, it cannot be<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>        done without following the due procedure as laid down<\/p>\n<p>        under the law.\n<\/p>\n<p>                  I, therefore, direct that the petitioner should<\/p>\n<p>        produce a copy of this order before the respondents 2<\/p>\n<p>        and 3 who will act in accordance with law and pass an<\/p>\n<p>        appropriate order before demolishing any part of the<\/p>\n<p>        house, if it has not yet been done.\n<\/p>\n<p>                  This writ application is disposed of with the<\/p>\n<p>        aforesaid observations and directions.<\/p>\n<pre>Anand                                         ( Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
