No.42296 of 2010\n                                NAND KUMAR PANDEY\n                                      Versus\n                                  STATE OF BIHAR\n                                      ------\n<\/pre>\n<p>2\/      31.03.2011               Heard learned counsel for the petitioner and learned<\/p>\n<p>                     counsel for the State.\n<\/p>\n<p>                                 There is case and counter case for the incident of the<\/p>\n<p>                     same day. Alleged injury of Khanti caused by the petitioner is found<\/p>\n<p>                     simple and theft is ornamental.\n<\/p>\n<p>                                 Taking that into consideration, prayer of the petitioner is<\/p>\n<p>                     allowed.\n<\/p>\n<p>                                 In the event of arrest or surrender within one month<\/p>\n<p>                     from the date of receipt\/production of a copy of this order in<\/p>\n<p>                     connection with Mali P.S. Case No.87 of 2010 above named<\/p>\n<p>                     petitioner shall be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                     10,000\/- (ten thousand) with two sureties of the like amount each to<\/p>\n<p>                     the satisfaction of C.J.M., Aurangabad (Bihar) subject to the<\/p>\n<p>                     conditions as laid down under Section 438(2) of Cr.
