KAIMUR AT BHABUA.\n                                                    -------- PETITIONERS\n                                      Versus\n                                  THE STATE OF BIHAR\n                                   -----------\n<\/pre>\n<p>2.   04.03.2011                Heard the parties.\n<\/p>\n<p>                               The petitioner has sought quashing of the order<\/p>\n<p>                    dated 20.7.2010 passed by learned F.T.C.- I, Kaimur at<\/p>\n<p>                    Bhabua in Sessions Trial No. 246 of 2008 by which an<\/p>\n<p>                    application filed on behalf of the petitioner for examination of<\/p>\n<p>                    Doctor and Investigating Officer has been disallowed.<\/p>\n<p>                               It has been submitted that the court did not exhaust<\/p>\n<p>                    the process for examination of these two important witnesses<\/p>\n<p>                    and disallowed the application on erroneous ground.<\/p>\n<p>                               On the other hand, the counsel for the Opposite<\/p>\n<p>                    Party submits that more than enough time had been given to<\/p>\n<p>                    the petitioner for examination of several witnesses and,<\/p>\n<p>                    therefore, no further time should be given.<\/p>\n<p>                               In my view, since the order impugned itself has<\/p>\n<p>                    mentioned that only summons had been issued to these two<\/p>\n<p>                    witnesses who are no doubt important for the ends of justice, I<\/p>\n<p>                    am inclined to allow this application and direct the trial court to<\/p>\n<p>                    issue bailable, non-bailable warrants as well as give Dasti<\/p>\n<p>                    summons simultaneously for these two witnesses within two<\/p>\n<p>                    weeks from the date of receipt of this order so that the trial court<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        is not heldup any more but at the same time the ends of justice<\/p>\n<p>        does not suffer.\n<\/p>\n<p>                   With these observations, the application is disposed<\/p>\n<p>        off.\n<\/p>\n<p>                   Let this order be communicated to the court of<\/p>\n<p>        F.T.C.-I, Kaimur at Bhabua, in Sessions Trial No. 246 of 2008,<\/p>\n<p>        through FAX at the cost of the petitioner.<\/p>\n<p>                                 ( Anjana Prakash, J.)<br \/>\nS.Ali\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Shailesh Kumar Tiwari @ Satish &#8230; vs State Of Bihar on 4 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
