Rakesh Kumar,J.              The   sole       petitioner,        while    invoking<\/p>\n
                  inherent    jurisdiction           of    this    Court        under<\/p>\n
                  Section     482        of    the        Code    of      Criminal<\/p>\n
                  Procedure,       has    prayed     for     quashing          of   an<\/p>\n
                  order dated 18.12.2002 passed by                       the    Chief<\/p>\n
                  Judicial Magistrate, Begusarai in Mansoorchak<\/p>\n
                  Non F.I.R. No.1 of 2002. By the said order,<\/p>\n
                  the learned Magistrate has taken cognizance<\/p>\n
                  of the offence under Sections 182 and 211 of<\/p>\n
                  the Indian Penal Code.\n<\/p>\n
                             2. Short fact of the case is that on<\/p>\n
                  the basis of written report submitted by the<\/p>\n
                  petitioner, an F.I.R. vide Mansoorchak P.S.<\/p>\n
                  Case    No.106     of       2002    was        registered         on<\/p>\n
                  7.9.2002 for the offence under Section 379 of<\/p>\n
                  the    Indian    Penal      Code    against      three       named<\/p>\n
                  accused persons. It was alleged in the F.I.R.
\n                       2<\/span><\/p>\n
that while the informant was returning by a<\/p>\n
Scooter,       the        three     named       accused       persons<\/p>\n
intercepted          the        informant        and    they      took<\/p>\n
forcibly Scooter as well as Rs.12,000\/- from<\/p>\n
the pocket of the petitioner. In the first<\/p>\n
information         report,        the    informant       has      also<\/p>\n
disclosed       that        the    accused        persons         while<\/p>\n
forcibly       taking       away     Rs.12,000\/-          from      the<\/p>\n
pocket of the informant, had said that since<\/p>\n
the    accused            persons        were     earlier         made<\/p>\n
accused,       for        the     legal     expenses         it     was<\/p>\n
necessary       to    take       money.     After       registering<\/p>\n
F.I.R.,       police       thoroughly        investigated           the<\/p>\n
same. During investigation, it was found that<\/p>\n
due to old litigations, the present case was<\/p>\n
cooked    up    by        the    informant       and    as    such   a<\/p>\n
final report was submitted mentioning therein<\/p>\n
the    case    as     un-true.       Besides       filing         final<\/p>\n
report,       the    police       also     lodged       prosecution<\/p>\n
report vide Mansoorchak Non F.I.R. No.1 of<\/p>\n
2002     on    31.10.2000.          After        filing      of    the<\/p>\n
complaint,           the        learned         Chief        Judicial<\/p>\n
Magistrate,         by     its    order     dated       18.12.2002,<\/p>\n
took cognizance of offence under Sections 182<\/p>\n
and    211      of        the     Indian     Penal       Code      and<\/p>\n
transferred         the     case    to     the    court      of   Shri<\/p>\n
K.K. Sinha, Judicial Magistrate, Ist Class,
\n                       3<\/span><\/p>\n
Begusarai.\n<\/p>\n
            3.    Aggrieved               with     the        order     of<\/p>\n
cognizance        and       proceeding,            the     petitioner<\/p>\n
approached this Court by filing the present<\/p>\n
petition.        It       was    admitted          on     20.10.2003.<\/p>\n
While admitting, it was directed that during<\/p>\n
the   pendency         of       this      application,          further<\/p>\n
proceeding        pending            in     the    court        of     the<\/p>\n
Judicial Magistrate, Ist Class, Begusarai in<\/p>\n
Tr.   No.1125         of    2003          shall    remain           stayed.<\/p>\n
Order of stay is still continuing.<\/p>\n
            4.        Learned              counsel            for      the\n\npetitioner,           while          pressing           the     present\n\npetition,        submits             that        even     while        the\n\ninvestigation         was       going       on,    the     petitioner\n\nwas   apprehending              that       police       may     not     do\n\n<\/pre>\n
justice with the investigation and as such he<\/p>\n
had filed a protest petition. Learned counsel<\/p>\n
for the petitioner submits that once protest<\/p>\n
petition     was      filed,         the     learned       Magistrate<\/p>\n
was   not    required           to    proceed       with       the    case<\/p>\n
against the petitioner and as such the order<\/p>\n
of cognizance is liable to be set aside.<\/p>\n
            5. Smt. Anita Kumari Singh, learned<\/p>\n
Additional        Public         Prosecutor             appearing       on<\/p>\n
behalf of the State has opposed the prayer of<\/p>\n
the petitioner.\n<\/p>\n
                        4<\/span><\/p>\n
             6.   Besides         hearing    learned       counsel<\/p>\n
for    the    parties,        I    have     also   perused      the<\/p>\n
materials available on record. Along with the<\/p>\n
petition, there is nothing on record to show<\/p>\n
as     to    whether        protest       petition      was   ever<\/p>\n
treated      as   complaint         case    nor    it   has   been<\/p>\n
argued by learned counsel for the petitioner<\/p>\n
that        protest        petition        was     treated      as<\/p>\n
complaint case and court has proceeded with<\/p>\n
the     complaint          case.    In      absence     of    such<\/p>\n
material, the court is of the view that while<\/p>\n
taking       cognizance,           by      its     order      dated<\/p>\n
18.12.2002,           the     learned        Magistrate         has<\/p>\n
committed no error. I do not find any merit<\/p>\n
in the present petition and petition stands<\/p>\n
rejected.\n<\/p>\n
             7.   In       view    of     rejection      of    this<\/p>\n
petition,         interim         order      of     stay      dated<\/p>\n
20.10.2003 stands automatically vacated.<\/p>\n
             8. Let a copy of this order be sent<\/p>\n
to the court below forthwith.\n<\/p>\n<\/p>\n
