Justice K.T.SANKARAN\n\n Dated :29\/10\/2009\n\n O R D E R\n                        K.T.SANKARAN, J.\n                  ---------------------------------------------\n                         B.A.No.3697 of 2009\n                  ---------------------------------------------\n             Dated this the 29th day of October, 2009\n\n\n\n                               ORDER\n<\/pre>\n<p>      This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure. The petitioner is the<\/p>\n<p>accused in Crime No.764 of 2008 of Kottayam West Police<\/p>\n<p>Station.\n<\/p>\n<p>     2.    The offences alleged against the petitioner are under<\/p>\n<p>Sections 406, 420, 467, 468 and 417 of the Indian Penal Code.<\/p>\n<p>     3.    The petitioner is an advocate clerk aged more than 65<\/p>\n<p>years.   The defacto complainant is an advocate practicing at<\/p>\n<p>Kottayam under whom the petitioner was working as clerk. It is<\/p>\n<p>submitted    by the learned counsel for the petitioner and the<\/p>\n<p>learned counsel appearing for the defacto complainant that a<\/p>\n<p>part of the disputes could be settled between the parties and<\/p>\n<p>efforts are going on to settle the disputes.<\/p>\n<p>     4.    Taking     into     account         the      peculiar facts and<\/p>\n<p>circumstances of the case,          I am of the view that anticipatory<\/p>\n<p>bail can be granted to the petitioner.<\/p>\n<p><span class=\"hidden_text\">BA No.3697\/2009                   2<\/span><\/p>\n<p>     There will be a direction that in the event of the arrest of<\/p>\n<p>the petitioner, the officer in charge of the police station shall<\/p>\n<p>release him on bail on his executing bond for Rs.15,000\/- with<\/p>\n<p>two solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<p>a)   The petitioner shall appear before the investigating officer<br \/>\n     for interrogation as and when required;<\/p>\n<p>b)   The petitioner shall not try to influence the prosecution<br \/>\n     witnesses or tamper with the evidence;<\/p>\n<p>c)   The petitioner shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;<\/p>\n<p>d)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.<\/p>\n<p>     The Bail Application is allowed to the extent indicated<\/p>\n<p>above.\n<\/p>\n<\/p>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                    JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.P.
