No.29714\/2009-H\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n           Dated this the 30th day of August, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    The petitioner challenges the order of confiscation of<\/p>\n<p>the  vehicle,   namely,   TN-47-S-6061   by  the   District<\/p>\n<p>Collector.  As per Ext.P5 order, the petitioner is directed<\/p>\n<p>to pay a sum of Rs.9,50,000\/- failing which the vehicle<\/p>\n<p>shall be auctioned as per the Rules.\n<\/p>\n<p>    2.   The  learned  Senior  Counsel  appearing  for the<\/p>\n<p>petitioner  submitted  that   the  petitioner&#8217;s  lorry  was<\/p>\n<p>engaged  by  one   Sri  Ganapathi   Traders,  Palakkad for<\/p>\n<p>transporting river sand from the State of Tamil Nadu to<\/p>\n<p>State of Kerala.  Ext.P1 is the invoice and Value Added Tax<\/p>\n<p>was paid by the petitioner in the name of Sri Ganapathi<\/p>\n<p>Traders, Palakkad as per Ext.P2.  Ext.P3 is the copy of the<\/p>\n<p>delivery note showing payment of the Kerala Value Added<\/p>\n<p>Tax.   Sand was to be delivered at Irinjalakuda for the<\/p>\n<p>customer of Sri Ganapathi Traders, Palakkad.    During the<\/p>\n<p>transportation of the same, it was intercepted by the<\/p>\n<p>Circle Inspector, Cherp Police Station and, thereafter, it<\/p>\n<p>was produced before the District Collector.   It is pointed<\/p>\n<p>out that the petitioner had purchased the sand from an<\/p>\n<p>authorised dealer of Tamil Nadu.    It is pointed out that<\/p>\n<p>there  was  no  allegation  that  the  sand  was  collected<\/p>\n<p>W.P.(C). No.29714\/2009<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>anywhere     within    the  limits    of  State  of Kerala  and,<\/p>\n<p>therefore, the provisions of Section 23 of the Kerala<\/p>\n<p>Protection of River Banks and Regulation of Removal of Sand<\/p>\n<p>Act, 2001 will not apply.\n<\/p>\n<p>     3.      In Ext.P5, the District Collector concluded that<\/p>\n<p>the transport        of  river  sand   is  not  a legal  one and<\/p>\n<p>therefore, there is violation of Kerala Protection of River<\/p>\n<p>Banks and Regulation of Removal of Sand Act, 2001.           The<\/p>\n<p>District Collected relied upon the Judgment in W.P.(C).<\/p>\n<p>No.3656\/2008 to conclude that unless the bills issued by<\/p>\n<p>the Public Works Department of Tamil Nadu are produced, no<\/p>\n<p>other evidence can be accepted.\n<\/p>\n<p>     4.      Heard    the learned    Government Pleader for the<\/p>\n<p>respondents.      In the statement filed on behalf of the first<\/p>\n<p>respondent,     the    allegation  is   that  the petitioner has<\/p>\n<p>violated the provisions of M.M.(D&amp;R) Act.            It is also<\/p>\n<p>mentioned that the transportation of river sand was not<\/p>\n<p>allowed from Tamil Nadu to any other State, going by the<\/p>\n<p>Tamil Nadu Minor Mineral Concession Rules with effect from<\/p>\n<p>25\/08\/2006.\n<\/p>\n<p>     5.      Evidently, those are not aspects covered by the<\/p>\n<p>impugned order passed by the District Collector as per<\/p>\n<p>Ext.P5.\n<\/p>\n<p>     6.      The proceedings for confiscation really requires a<\/p>\n<p>proper adjudication of the matter in the light of the<\/p>\n<p>W.P.(C). No.29714\/2009<br \/>\n<span class=\"hidden_text\">                               -:3:-<\/span><\/p>\n<p>provisions of the Kerala Protection of River Banks and<\/p>\n<p>Regulation of Removal of Sand Act, 2001.      The question is<\/p>\n<p>whether any provision of the said Act is attracted to the<\/p>\n<p>facts situation here.        There is no allegation evidently<\/p>\n<p>that the sand was collected from any of the rivers in<\/p>\n<p>Kerala.      The further question therefore, is whether the<\/p>\n<p>transportation from Tamil Nadu is correct or not.          The<\/p>\n<p>learned     counsel   for the petitioner  submitted  that  the<\/p>\n<p>petitioner is prepared to adduce further evidence in the<\/p>\n<p>matter if a proper opportunity is given.<\/p>\n<p>     7.      In the light of the fact that the matter requires<\/p>\n<p>a proper consideration after allowing the petitioner to<\/p>\n<p>adduce further evidence in the matter, Ext.P5 is set aside.<\/p>\n<p>There will be a direction to the competent authority to<\/p>\n<p>reconsider the matter in the light of the findings rendered<\/p>\n<p>above.    The petitioner can produce further evidence to show<\/p>\n<p>that the import of sand was justified and a fresh order<\/p>\n<p>will be passed by the designated authority within a period<\/p>\n<p>of one month from the date of receipt of a copy of this<\/p>\n<p>Judgment.\n<\/p>\n<p>     The writ petition is disposed of as above.
