Justice ANTONY DOMINIC\n\n Dated :21\/11\/2007\n\n O R D E R\n                  ANTONY DOMINIC, J\n                       -------------------\n                   W.P.(C). 34381\/2007\n                       --------------------\n         Dated this the 21st day of November, 2007\n\n                       JUDGMENT\n<\/pre>\n<p>      This writ petition is filed seeking the following<\/p>\n<p>reliefs:-\n<\/p>\n<blockquote><p>     (i).  issue a writ of mandamus or any other<\/p>\n<p>     writ   order   or    direction        directing the<\/p>\n<p>     respondents to permit the petitioner to remit<\/p>\n<p>     the building tax due as per Ext.P1 order in<\/p>\n<p>     four equal quarterly instalments.<\/p>\n<\/blockquote>\n<blockquote><p>     (ii). Issue a writ of mandamus or any other<\/p>\n<p>     writ order or direction directing the 2nd<\/p>\n<p>     respondent to accept the Ext.P2 appeal on the<\/p>\n<p>     petitioner remitting 1\/4th of the building tax<\/p>\n<p>     due as per Ext.P1 order.<\/p><\/blockquote>\n<p>      The petitioner submits that against Ext.P1 order of<\/p>\n<p>assessment the petitioner had filed Ext.P2 appeal. There<\/p>\n<p>upon he was informed by Ext.P3 to remit               the first<\/p>\n<p>instalment. Petitioner submits that though he is willing to<\/p>\n<p>pay the same which is 1\/4th of the tax due in terms of the<\/p>\n<p>provisions of the Act, he has been called upon to pay 1\/3rd<\/p>\n<p>W.P.(C).34381\/2007<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>amount as per the order of assessment itself and this<\/p>\n<p>demand for remittance of 1\/3rd led the petitioner to file<\/p>\n<p>this writ petition.\n<\/p>\n<\/p>\n<p>      In view of the provisions contained in the Act,<\/p>\n<p>liability  is only to pay &lt;th of the tax.    Therefore, I<\/p>\n<p>dispose of this writ petition directing the second<\/p>\n<p>respondent to accept the appeal filed by the petitioner on<\/p>\n<p>the petitioner remitting &lt;th of the tax due in compliance<\/p>\n<p>with what is indicated in Ext.P4. On such remittance the<\/p>\n<p>appeal shall be dealt with on merits.
