Petitioner is a Bank which had allowed loan<\/p>\n<p>facility to respondents 1 &amp; 2.                 Immovable properties<\/p>\n<p>belonging to the respondents 1 &amp; 2 was proceeded against<\/p>\n<p>under    the    provisions         of     the      Securitization and<\/p>\n<p>Reconstruction of Financial Assets and Enforcement of<\/p>\n<p>Security Interest Act, 2002 (SARFAESI Act) consequent to<\/p>\n<p>default committed in repayment. It is submitted that the<\/p>\n<p>proceedings are under the stage of Section 13 (4) and<\/p>\n<p>notice for taking over possession of the property has<\/p>\n<p>already been published. The Bank had also proclaimed sale<\/p>\n<p>of the immovable property.                  At this stage, without<\/p>\n<p>intimation to the Bank, the defaulters who are the owners of<\/p>\n<p>the secured assets, had entered into a lease with the<\/p>\n<p>3rd respondent whereby the 3rd respondent is permitted to<\/p>\n<p>W.P.(C)No.30200 of 2009<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>install a Motor Workshop in the property.                The<\/p>\n<p>3rd respondent had approached the 4th respondent<\/p>\n<p>Municipality for getting installation permission.        The<\/p>\n<p>petitioner Bank as well as a neighboring 3rd party had<\/p>\n<p>opposed granting of installation permission.     The matter<\/p>\n<p>was once taken up to the Tribunal for Local Self<\/p>\n<p>Government Institutions at the instance of the neighboring<\/p>\n<p>resident. The Tribunal directed the Municipality to hear<\/p>\n<p>objections of the parties, including the petitioner Bank,<\/p>\n<p>before taking a decision.       Now the 4th respondent<\/p>\n<p>Municipality, had adopted a resolution as evidenced by<\/p>\n<p>Ext.P4 whereby it is decided to grant installation permission<\/p>\n<p>to the 3rd respondent.    Petitioner is challenging Ext.P4<\/p>\n<p>decision of the Municipality on the ground that the lease<\/p>\n<p>created subsequent to initiation of proceedings under the<\/p>\n<p>SARFAESI Act is totally illegal and invalid. Contention is<\/p>\n<p>that, since the 3rd respondent is not getting any right by<\/p>\n<p>virtue of the lease so created, the Municipality ought not<\/p>\n<p>have granted installation permission.<\/p>\n<p>W.P.(C)No.30200 of 2009<br \/>\n<span class=\"hidden_text\">                              -3-<\/span><\/p>\n<p>      2.    Going by provisions of Section 13 (13) of the<\/p>\n<p>SARFAESI Act, the borrower is prevented from transferring<\/p>\n<p>the secured assets by way of sale, lease or otherwise with<\/p>\n<p>respect to any of his assets referred to in the notice, after<\/p>\n<p>receipt of the notice under Section 13 (2), without prior<\/p>\n<p>written consent of the secured creditor. Therefore as far as<\/p>\n<p>the secured creditor is concerned, the lease agreement<\/p>\n<p>created by the borrower can be considered as a nullity and<\/p>\n<p>further steps under the Act can be persued ignoring<\/p>\n<p>creation of any such lease.\n<\/p>\n<p>      3.    As far as the impugned resolution adopted by the<\/p>\n<p>Municipality is concerned, noticed that the Municipality had<\/p>\n<p>observed that the 3rd respondent is entitled to get<\/p>\n<p>installation permission since they had complied with all the<\/p>\n<p>requirements stipulated under the Municipality Act as well<\/p>\n<p>as the relevant Rules framed thereunder. I am not entering<\/p>\n<p>into the merits of the decision and deciding the question<\/p>\n<p>regarding sustainability of the resolution, because there is<\/p>\n<p>an alternate remedy provided under the Act against such<\/p>\n<p>W.P.(C)No.30200 of 2009<br \/>\n<span class=\"hidden_text\">                             -4-<\/span><\/p>\n<p>decision by way of appeal to the Tribunal for Local Self<\/p>\n<p>Government Institutions.    Further, counsel appearing for<\/p>\n<p>the 2nd respondent had brought to my notice that against<\/p>\n<p>Ext.P4 decision the 3rd party (neighbouring resident) who<\/p>\n<p>was objecting such grant of installation permission, had<\/p>\n<p>already approached this court by writ petition No.W.P.(C)<\/p>\n<p>No.29317\/09. The petitioner Bank is a respondent in that<\/p>\n<p>writ petition and was represented by counsel. In the<\/p>\n<p>judgment rendered by this court in that case, W.P.(C)<\/p>\n<p>No.29317\/09, dated 21.10.2009, this court had relegated<\/p>\n<p>the parties to approach the Tribunal against Ext.P4 order by<\/p>\n<p>resorting to the appellate remedy. Therefore the petitioner<\/p>\n<p>if aggrieved by Ext.P4 can resort to remedy by way of<\/p>\n<p>appeal.\n<\/p>\n<p>      4.    However it is made clear that Ext.P4 will not<\/p>\n<p>stand in the way of the petitioner Bank proceeding with<\/p>\n<p>further steps under the SARFAESI Act and from taking over<\/p>\n<p>possession of the secured assets resorting to procedures<\/p>\n<p>contemplated therein.\n<\/p>\n<p>W.P.(C)No.30200 of 2009<br \/>\n<span class=\"hidden_text\">                             -5-<\/span><\/p>\n<p>      5.    Under the above circumstances the writ petition<\/p>\n<p>is dismissed without prejudice to the rights of the petitioner<\/p>\n<p>Bank to invoke the appellate remedy available against the<\/p>\n<p>impugned decision under Ext.P4.\n<\/p>\n<\/p>\n<p>                                        C.K.
