PUBLIC PROSECUTOR for\nRespondent(s) : 1, \nNone for Respondent(s) : 2 -\n3. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 16\/03\/2010\n \n\nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tapplicant has preferred this application for cancellation of regular<br \/>\n\tbail granted to the respondent no.3-original accused vide order<br \/>\n\tdated 10th March 2010 passed by the learned Additional<br \/>\n\tSessions Judge, 2nd Fast Track Court, Himmatnagar, Camp<br \/>\n\tat Idar, in Criminal Miscellaneous Application No.168 of 2010.\n<\/p>\n<p>Against<br \/>\n\tthe present respondent no.3-original accused, initially complaint<br \/>\n\twas filed on 12th February, 2010 for the offence<br \/>\n\tpunishable under Section 354 of the Indian Penal Code registered<br \/>\n\twith Idar Police Station being CR No I-12 of 2010. Thereafter, by<br \/>\n\torder dated 03rd March 2010, the learned Principal Senior<br \/>\n\tCivil Judge and Judicial Magistrate First Class, Idar allowed the<br \/>\n\tapplication dated 25th February 2010 of the Police<br \/>\n\tInspector, Idar Police Station and ordered the Investigating Officer<br \/>\n\tto add Sections 376 and 511 of the Indian Penal Code in the<br \/>\n\tcomplaint being CR No. I-12 of 2010, against the respondent<br \/>\n\tno.3-accused.\n<\/p>\n<p>The<br \/>\n\trespondent no.3-accused was arrested on 13th February<br \/>\n\t2010 i.e. the date on which complaint was lodged and on the same<br \/>\n\tday, i.e. on 13th February 2010, the respondent<br \/>\n\tno.3-accused was released on regular bail. Subsequently, the<br \/>\n\toffences under Sections 376 and 511 of the Indian Penal Code were<br \/>\n\tadded as per the order dated 03rd March 2010, the<br \/>\n\trespondent no.3-accused preferred an application under Section 438<br \/>\n\tof the Code of Criminal Procedure, 1973 before the learned District<br \/>\n\tSessions Judge, Sabarkantha on 08th March 2010 being<br \/>\n\tCriminal Miscellaneous Application No.168 of 2010. The learned<br \/>\n\tAdditional Sessions Judge, 2nd Fast Track Court,<br \/>\n\tHimmatnagar, Camp at Idar, allowed the said application of the<br \/>\n\trespondent no.3-accused and granted anticipatory bail to the<br \/>\n\trespondent no.3-accused.\n<\/p>\n<p>Heard<br \/>\n\tMr. Samir Dave, learned counsel for the applicant. He has contended<br \/>\n\tthat the learned Judge has not considered the seriousness of the<br \/>\n\toffence committed by the respondent no.3-accused. He has also<br \/>\n\tcontended that if the respondent no.3-accused is released on bail,<br \/>\n\the is likely to directly or indirectly induce and threat the<br \/>\n\tapplicant-original complainant. He has also contended that the<br \/>\n\tlearned Judge has not considered the facts of the case and wrongly<br \/>\n\tgranted bail to the respondent no.3-accused.\n<\/p>\n<p>I<br \/>\n\thave gone through the papers produced before me and also gone<br \/>\n\tthrough the order passed by the Trial Court. Today Mr. Dave is<br \/>\n\tunable to convince this Court about the ground on which bail can be<br \/>\n\tcancelled.\n<\/p>\n<p>In<br \/>\n\tview of above, in my opinion, the applicant has not produced any<br \/>\n\tsatisfactory evidence to cancel the bail granted by the learned<br \/>\n\tAdditional Sessions Judge, 2nd Fast Track Court,<br \/>\n\tHimmatnagar, Camp at Idar, to the respondent no.3-accused and,<br \/>\n\ttherefore, no interference is required to be called for by this<br \/>\n\tCourt. Prayer prayed for by the learned counsel for the applicant<br \/>\n\tMr. Dave to permit him to move application for cancellation of bail<br \/>\n\tbefore the trial Court is granted.
