Justice M.N.KRISHNAN\n\n Dated :30\/09\/2008\n\n O R D E R\n                          M.N.KRISHNAN, J.\n                        -------------------------\n                        M.A.C.A.No.95 of 2006\n                    ---------------------------------\n           Dated, this the 30th day of September, 2008\n\n                            J U D G M E N T\n<\/pre>\n<p>      This appeal is preferred by the claimant, whose claim has<\/p>\n<p>been dismissed on the ground that he has contributed to the<\/p>\n<p>cause of the accident. The learned counsel would contend that<\/p>\n<p>the said finding is wrong. I will consider it differently under two<\/p>\n<p>headings, namely, the liability of the Insurance Company, so also<\/p>\n<p>whether there is a claim that can be entertained against the<\/p>\n<p>owner-cum-driver of the goods autorickshaw.                 So far as the<\/p>\n<p>Insurance Company is concerned, if a person is traveling in a<\/p>\n<p>goods autorickshaw, which is not designed to carry passengers, it<\/p>\n<p>will become a case of gratuitous passenger traveling in a vehicle.<\/p>\n<p>Admittedly, it is a goods autorickshaw and there is only one seat<\/p>\n<p>for the driver. The driver is not expected to carry anybody inside<\/p>\n<p>the said seat. This position is well settled by the decision of the<\/p>\n<p>Apex Court in United India Insurance Company Limited Vs.<\/p>\n<p>Suresh K.K. &amp; Another , reported in 2008 AIR SCW 4739. In<\/p>\n<p>paragraph 13 of the said decision, the Apex Court held that :-<\/p>\n<p>      &#8220;If the claimant had not been traveling in the vehicle as owner of<\/p>\n<p>M.A.C.A.No.95\/2006<br \/>\n<span class=\"hidden_text\">                                      -2-<\/span><\/p>\n<p>      the goods, he shall not be covered by the policy of the insurance.<\/p>\n<p>      In any view of the matter in a three wheeler goods carriage, the<\/p>\n<p>      driver could not have allowed anybody else to share his seat. No<\/p>\n<p>      other person whether as a passenger or as a owner of the vehicle<\/p>\n<p>      is supposed to share the seat of the driver.       Violation of the<\/p>\n<p>      condition of the contract of insurance, therefore, is approved.&#8221;<\/p>\n<p>In this case, the claimant was traveling in the platform of the<\/p>\n<p>autorickshaw. He was not expected to travel in the platform of<\/p>\n<p>the autorickshaw and therefore, that also militate against his<\/p>\n<p>claim from the Insurance Company. So, from these facts, I hold<\/p>\n<p>the Insurance Company cannot be liable.\n<\/p>\n<p>      2.    Now, the next question is regarding the liability of the<\/p>\n<p>owner-cum-driver of the autorickshaw.              An owner of a goods<\/p>\n<p>autorickshaw is not expected to carry a person on the platform of<\/p>\n<p>the vehicle or on the seat, which can only accommodate one. In<\/p>\n<p>such cases, when a person is permitted to travel, there is primary<\/p>\n<p>negligence on the part of owner-cum-driver. At the most, the<\/p>\n<p>conduct of the claimant would attract contributory negligence and<\/p>\n<p>not total negligence.           So, it is a matter that requires<\/p>\n<p>consideration and the finding of the Tribunal that the claimant is<\/p>\n<p>totally contributed to the accident and is improper is liable to be<\/p>\n<p>M.A.C.A.No.95\/2006<br \/>\n<span class=\"hidden_text\">                                -3-<\/span><\/p>\n<p>set aside. Therefore, the award under challenge is set aside and<\/p>\n<p>the matter is remitted back to the Tribunal.<\/p>\n<p>(1)  It is found that the Insurance Company cannot be mulcted<\/p>\n<p>with the liability.\n<\/p>\n<p>(2)  The Tribunal shall permit the claimant to adduce evidence in<\/p>\n<p>support of his contention regarding the negligence of the owner-<\/p>\n<p>cum-driver.\n<\/p>\n<p>(3)  Since the owner-cum-driver has not appeared before the<\/p>\n<p>Tribunal or before this Court, the claimant is directed to take<\/p>\n<p>notice to him and the Tribunal, after permitting him to file a<\/p>\n<p>written statement, shall dispose of the matter in accordance with<\/p>\n<p>law.\n<\/p>\n<p>(4)  The claimant is directed to appear before the Tribunal on<\/p>\n<p>18\/11\/2008.\n<\/p>\n<\/p>\n<p>                                      (M.N.KRISHNAN, JUDGE)<\/p>\n<p>jg<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court P.R.
