AGP for Respondents :\n1 - 3. \n================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/12\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>The<br \/>\n\tpresent appeal arise against the judgment &amp; order dated<br \/>\n\t17\/8\/2001 passed by learned Single Judge of this Court in Special<br \/>\n\tCivil Application No. 5031 of 2000, whereby the order passed by the<br \/>\n\tRevenue Tribunal, under Gujarat Agricultural Lands Ceiling Act, 1960<br \/>\n\t(herein after referred to as the &#8216;Act&#8217;) is not interfered with.\n<\/p>\n<p>For<br \/>\n\tthe sake of convenience, the parties shall be referred to as per<br \/>\n\ttheir status in the proceedings before learned Single Judge.\n<\/p>\n<p>The<br \/>\n\trelevant facts are that the petitioner on the appointed date of<br \/>\n\t1\/4\/1976 was holding total agricultural lands of 25 acres &amp; 39<br \/>\n\tgunthas. Petitioner filled up the form since the land held by him<br \/>\n\twas exceeding the prescribed limit. Mamlatdar ultimately processed<br \/>\n\tthe form and after recording evidence and other material land held<br \/>\n\tin excess of prescribed limit was declared as surplus land to be<br \/>\n\tacquired by the Government. It appears that, thereafter the matter<br \/>\n\twas carried before Dy. Collector and before the Tribunal, and<br \/>\n\tultimately before this Court in Special Civil Application No. 612 of<br \/>\n\t1983. This Court in the said matter vide it decision dated 17\/7\/1991<br \/>\n\tremanded the matter on the ground as to whether the benefit of<br \/>\n\tSection 6 (3)(B) would be available to the members of the family or<br \/>\n\tnot. Thereafter it appears that the matter was once again considered<br \/>\n\tby the Mamlatdar and vide his decision dated 4\/9\/1992 said claim was<br \/>\n\taccepted, against which  the matter was carried before Dy. Collector<br \/>\n\tin Appeal No. 38\/1993, and the Dy. Collector vide his order dated<br \/>\n\t22\/11\/1993 set aside the order of Mamlatdar and remanded the matter<br \/>\n\tto Mamlatdar for reconsideration. The  Mamlatdar, thereafter, vide<br \/>\n\this order dated 13\/9\/1995 held that family of the petitioner was<br \/>\n\tcomprising of 7 members as on 1\/4\/1976,  and, therefore, he would be<br \/>\n\tentitled to retain land of one unit + 2\/5 of the unit and remaining<br \/>\n\tland would be surplus land. Petitioner, therefore, preferred appeal<br \/>\n\tbeing Appeal No. 26\/1995 before Dy. Collector, which came to be<br \/>\n\tdismissed on 8\/1\/1996. The matter was further carried in revision<br \/>\n\tbefore the Revenue Tribunal, which also came to be dismissed on<br \/>\n\t30\/9\/1979. Being aggrieved by the said decision of all the lower<br \/>\n\tauthorities, petitioner approached before this Court by preferring<br \/>\n\tpresent Special Civil Application. Learned Single Judge found that<br \/>\n\tthere is no case for interference and confirmed the order of the<br \/>\n\tTribunal. Under these circumstances, present appeal before us.\n<\/p>\n<p>We<br \/>\n\thave heard Mr. Kharadi, learned counsel appearing for the appellant<br \/>\n\tand Ms. Nair, learned AGP for the respondents.\n<\/p>\n<p>The<br \/>\n\tonly aspect which may be required to be considered in the present<br \/>\n\tappeal is, as to whether, mother of the petitioner would be entitled<br \/>\n\tto  a separate unit as per the provisions of the Act or not.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tKharadi, learned counsel has heavily relied upon the decision of<br \/>\n\tthis Court in case of STATE OF GUJARAT Vs. PATEL KALA SANA &amp;<br \/>\n\tORS, reported in 1994 (1) GLR pg. 448, and he contended that, in the<br \/>\n\tsaid decision it was found by another learned Single Judge of this<br \/>\n\tCourt that mother would be entitled for separate unit even if the<br \/>\n\tfather is lot alive. Therefore, he submitted that the appeal<br \/>\n\tdeserves to be allowed and the order of all the authorities deserved<br \/>\n\tto be quashed and set aside. He contended that, if separate unit of<br \/>\n\tthe mother is considered, there will not be any surplus land and<br \/>\n\thence this Court may consider the said aspects.\n<\/p>\n<p>Whereas,<br \/>\n\tlearned AGP has submitted that the order passed by all the lower<br \/>\n\tauthorities,  and also of the learned Single Judge, are in<br \/>\n\taccordance with law and there is no need to reverse  the same.\n<\/p>\n<p>We<br \/>\n\tmay record that, it is an admitted fact that the land in question<br \/>\n\twas not held by father of the petitioner on the appointed date, but<br \/>\n\twas held by the petitioner himself, who had filled up the form. In<br \/>\n\tthe order of Mamlatdar &amp; ALT dated 4\/9\/1992, copy whereof is<br \/>\n\tproduced at Annexure-A, it has been recorded that in the deposition<br \/>\n\tof the land holder, i.e. the petitioner, it has come out that the<br \/>\n\tland was originally held by forefathers of the petitioner.<br \/>\n\tThereafter, there was division between brother of the petitioner and<br \/>\n\tthe petitioner himself and he had received share of the land<br \/>\n\tadmeasuring 10 acres 02 gunthas in partition.  Additionally,<br \/>\n\tthereafter petitioner acquired land as a tenant and in this manner<br \/>\n\ton the appointed date of 1\/4\/1976 he was holding agricultural land<br \/>\n\tadmeasuring 25 acres &amp; 39 gunthas. It is not the case of the<br \/>\n\tpetitioner that the land was held by father of the petitioner and he<br \/>\n\twas staying  with his father in the family. Under these<br \/>\n\tcircumstances, the holding is to be considered on the appointed date<br \/>\n\tand the family is also to be considered on the appointed date. Said<br \/>\n\taspect is clear from the language of Sub section (3 D) of Section 6<br \/>\n\tof the Act, which reads as under.\n<\/p>\n<p><span class=\"hidden_text\"> 6<\/span><\/p>\n<p>(3D) For the purpose of sub-section (2), (3B) or (3C), the members<br \/>\ncomprised in a family or as the case may be, a joint family on the<br \/>\nspecified date shall alone be taken into consideration and any<br \/>\nchanges in the character or number of members of the family occurring<br \/>\nthereafter shall be ignored.\n<\/p>\n<p>Therefore,<br \/>\n\tthe test would be that, what was the position on the appointed date.<br \/>\n\tIf the petitioner was holding land on the appointed date, it is the<br \/>\n\tholding of the petitioner to be considered for the purpose of the<br \/>\n\tAct. The family comprised of the petitioner, which may include<br \/>\n\tmother, is to be taken into consideration for the purpose of ceiling<br \/>\n\tlimit.\n<\/p>\n<p>\tIf<br \/>\n\tthe aforesaid position is considered with the facts of the present<br \/>\n\tcase, then the number of members of the family of the petitioner was<br \/>\n\tseven which exceeded five, and therefore as per provision of Section<br \/>\n\t6 (3B), one unit + 1\/5th of the unit for each additional<br \/>\n\tmember is to be calculated. As there are two additional members,<br \/>\n\texceeding five members, 2\/5th of the unit would be<br \/>\n\tavailable in addition to one unit to the petitioner. The same is<br \/>\n\tpermitted by the lower authorities and is confirmed by the Tribunal<br \/>\n\tas well as by learned Single Judge of this Court.\n<\/p>\n<p>\tReliance<br \/>\n\tupon the decision of this Court in case of State of Gujarat Vs.<br \/>\n\tPatel Kala Sana (supra) is ill-founded, in as much as, in the said<br \/>\n\tdecision, this Court did not consider the question of consequences<br \/>\n\tarising if the land was held by the son and son had a separate<br \/>\n\tfamily wherein mother was living together. Observations of this<br \/>\n\tCourt on above referred decision  may apply in the event the land is<br \/>\n\theld by the father  may not be surviving, leaving mother as one of<br \/>\n\tthe parents and the major son living  together with the family of<br \/>\n\tthe major son. Same is not the fact situation in the present case.\n<\/p>\n<p>\tIn<br \/>\n\tview of the aforesaid observations, we are in agreement with the<br \/>\n\tview taken by learned Single Judge. Hence the appeal is meritless,<br \/>\n\ttherefore dismissed. Interim relief granted vide order dated<br \/>\n\t1\/8\/2002 by Division Bench of this Court while allowing Civil<br \/>\n\tApplication No. 11916 of 2001 in LPA No. 1193 of 2001 shall stand<br \/>\n\tvacated.
