Having regard to the facts and circumstances of the case, the<br \/>\n\tpresent application is taken up for final hearing today.\n<\/p>\n<p>This<br \/>\n\tis an application preferred under section 439 of Code of Criminal<br \/>\n\tProcedure, 1973 by the applicant who has been arrested in connection<br \/>\n\twith First Information Report being I-C.R.No.100 of 2009 registered<br \/>\n\twith Sarkhej Police Station, Ahmedabad for the offences punishable<br \/>\n\tunder sections 406, 420, 120(B) and 114 of Indian Penal Code read<br \/>\n\twith sections 3 and 5 of the Prize Chits &amp; Money Circulation<br \/>\n\tSchemes (Banning) Act, 1978 and section 3 of the Benami Transactions<br \/>\n\t(Prohibition) Acts, 1988.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel of both the sides at length and in great detail and<br \/>\n\tconsidered the role attributed to the applicant as reflected in<br \/>\n\tFirst Information Report and the police papers. I have also<br \/>\n\tconsidered provisions of sections 406, 420, 120(B) and 114 of Indian<br \/>\n\tPenal Code read with sections 3 and 5 of the Prize Chits &amp; Money<br \/>\n\tCirculation Schemes (Banning) Act, 1978 and section 3 of the Benami<br \/>\n\tTransactions (Prohibition) Acts, 1988, quantum of punishment,<br \/>\n\tgravity of offence, manner in which applicant is involved in the<br \/>\n\toffence, as well as the orders passed by this Court dated 04.03.2010<br \/>\n\tin Criminal Miscellaneous Application No.14618 of 2009, dated<br \/>\n\t08.12.2009 in Criminal Miscellaneous Application No.12952 of 2009<br \/>\n\tand dated 08.12.2009 in Criminal Miscellaneous Application No.12964<br \/>\n\tof 2009 as well as the orders passed by coordinate bench of this<br \/>\n\tCourt (Coram:Rajesh H. Shukla, J.) dated 05.10.2009 in Criminal<br \/>\n\tMiscellaneous Application No.11132 of 2009 and dated 05.10.2009 in<br \/>\n\tCriminal Miscellaneous Application No.11134 of 2009. Considering the<br \/>\n\taforesaid aspects, I am of the view that applicant deserves to be<br \/>\n\tenlarged on bail.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application is allowed and the applicant<br \/>\n\tis ordered to be enlarged on regular bail in connection with<br \/>\n\tI-C.R.No.100 of 2009 registered with Sarkhej Police Station,<br \/>\n\tAhmedabad on executing a bond of Rs.10,000\/- (Rupees Ten Thousand<br \/>\n\tOnly) with one surety of the like amount to the satisfaction of the<br \/>\n\tTrial Court and subject to the conditions that she shall,<\/p>\n<p>\t[a]<br \/>\n\tnot take undue advantage of her liberty or abuse her liberty;\n<\/p>\n<p>\t[b]<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>\t[c]<br \/>\n\tsurrender her passport, if any, to the lower Court within a week;\n<\/p>\n<p>\t[d]<br \/>\n\tnot leave the State of Gujarat without the prior permission of the<br \/>\n\tSessions Court concerned;\n<\/p>\n<p>\t[e]<br \/>\n\tfurnish the present address of her residence to the I.O. and also to<br \/>\n\tthe Court at the time of execution of the bond and shall not change<br \/>\n\ther residence without prior permission of this Court;\n<\/p>\n<p>\t[f]<br \/>\n\tmaintain law and order.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or to take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbond to be executed before the lower Court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>\tAt<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the petitioner on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
