APP (DB) No.228 of 2011\n                                   RAJESH PANDEY\n                                          Versus\n                                 THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>3   04-04-2011             Heard learned counsel for the appellants and<\/p>\n<p>                 learned counsel for the State in respect of appellants<\/p>\n<p>                 prayer for bail. Lower court records have been received.<\/p>\n<p>                           On 29-4-2008 during day hours an employee<\/p>\n<p>                 of Ideal Motors Private Limited at Muzaffarpur was shot<\/p>\n<p>                 dead and Rs. 11 lacs were allegedly looted by the<\/p>\n<p>                 miscreants who came on a motor cycle. The informant is<\/p>\n<p>                 the driver of the company vehicle which was with the<\/p>\n<p>                 cashier, the deceased. He described appellant Brajesh<\/p>\n<p>                 Mahto @Barj Kishore Mahto by physical feature leading<\/p>\n<p>                 to arrest of Brajesh Mahto and recovery of Rs.<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>1, 69, 500\/-, all notes in the denomination of Rs. 500\/-<\/p>\n<p>which tallied with the denomination of money looted.<\/p>\n<p>Even according to seizure list at least 16 notes recovered<\/p>\n<p>from him carried the seal and signature of Ideal Motors.<\/p>\n<p>           On the confession of Brajesh Mahto other two<\/p>\n<p>appellants were also apprehended leading to recovery of<\/p>\n<p>Rs. one lac from appellant, Rajesh Pandey and Rs.<\/p>\n<p>66,000\/- from appellant, Chandan Kumar. Again the<\/p>\n<p>notes in the denomination of Rs. 5, 00\/-. According to<\/p>\n<p>seizure list they contained marked notes bearing seal of<\/p>\n<p>Ideal Motors and signature at least on some notes. The<\/p>\n<p>arrests were made soon after the occurrence on 1st May<\/p>\n<p>or 2nd May, 2008.\n<\/p>\n<p>           It has been submitted that the two witnesses of<\/p>\n<p>seizure list have been turned hostile and the informant<\/p>\n<p>has identified only Brajesh Mahto.\n<\/p>\n<p>           Considering all the facts and circumstances<\/p>\n<p>and nature of the offence, the prayer of the appellants for<\/p>\n<p>bail is rejected at this stage.\n<\/p>\n<p>           Since appellant Chandan Kumar and Rajesh<\/p>\n<p>Pandey have been convicted only u\/s 412 of the IPC, it is<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>        observed that if their appeal cannot be heard within one<\/p>\n<p>        year, in that event, they may renew their prayer for bail.<\/p>\n<pre>\n\n\n\n                               (Shiva Kirti Singh, J.)\n\n\nBKS\/-                          (Gopal Prasad, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rajesh Pandey vs The State Of Bihar on 4 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
