No.20737 of 2010\n                  TUN TUN BISHWAKARMA SON OF LATE JAGO MISHTRI\n                                            Versus\n                                  THE STATE OF BIHAR\n                                        -----\n<\/pre>\n<p>2.   17.6.2010          Heard learned counsel for the petitioner and the State.<\/p>\n<p>                           The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence under sections 420, 465, 466, 467, 468, 471, 473\/34 of<\/p>\n<p>                 the Indian Penal Code and 17 of the Criminal Law Amendment<\/p>\n<p>                 Act.\n<\/p>\n<p>                           Considering that the petitioner is in custody since<\/p>\n<p>                 16.1.2010 and has no criminal antecedents, let the petitioner,<\/p>\n<p>                 named above, be released on bail on furnishing bail bonds of<\/p>\n<p>                 Rs. 5,000\/- (five thousand) with two sureties of the like amount<\/p>\n<p>                 each to the satisfaction of the Chief Judicial Magistrate, Munger<\/p>\n<p>                 in Kharagpur P.S.case No.20 of 2010, subject to the conditions<\/p>\n<p>                 (i) that one of the bailors will be a close relative of the petitioner,<\/p>\n<p>                 who will give an affidavit giving genealogy as to how he is<\/p>\n<p>                 related with the petitioner. The bailors will undertake to furnish<\/p>\n<p>                 information to the court about any change in the address of the<\/p>\n<p>                 petitioner, (ii) that the affidavit shall clearly state that the<\/p>\n<p>                 petitioner is not an accused in any other case and if he is, he<\/p>\n<p>                 shall not be released on bail, (iii) that the bailor shall also state<\/p>\n<p>                 on affidavit that he will inform the court concerned if the<\/p>\n<p>                 petitioner is implicated in any other case of similar nature after<\/p>\n<p>                 his release in the present case and thereafter the court below<\/p>\n<p>                 will be at liberty to initiate the proceeding for cancellation of bail<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            on the ground of misuse and (iv) that the petitioner will give an<\/p>\n<p>            undertaking that he will receive the police papers on the given<\/p>\n<p>            date and be present on the date fixed for charge and if he fails<\/p>\n<p>            to do so on two given dates and delays the trial in any manner,<\/p>\n<p>            his bail will be liable to be cancelled for reasons of misuse.<\/p>\n<p>                     The    fact    that   the   petitioner   has   no   criminal<\/p>\n<p>            antecedents will be verified by the Magistrate concerned before<\/p>\n<p>            releasing the petitioner on bail.\n<\/p>\n<\/p>\n<pre>Narendra\/                          ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Tun Tun Bishwakarma vs The State Of Bihar on 17 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
