Mr.Dabhi, learned Additional Public Prosecutor waives<br \/>\nservice of notice of Rule on behalf of respondent State.\n<\/p>\n<p>2.\tHeard<br \/>\nMs.Subhadra Patel, learned advocate for the applicant and Mr.Dabhi,<br \/>\nlearned APP for the respondent State.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the applicant has submitted that since 8th<br \/>\nFebruary, 2007, the applicant-convict is under trial prisoner. The<br \/>\napplicant seeks temporary bail for a period of 30 days on the ground<br \/>\nthat his wife was to be operated a major surgery of Hystrectomy on<br \/>\n23.06.2011, however, operation is now postponed on 27.06.2011. In<br \/>\nsupport of her submissions, learned advocate has produced certificate<br \/>\ndated 23.06.2011 issued by Dr.Mahendra L. Patel, M.B.B.S. M.R.S.M.<br \/>\n(London) of Arzoo (Pramukh) Hospital, Bhatar Rd. Surat clarifying the<br \/>\nsaid fact.\n<\/p>\n<p>4.\tHaving<br \/>\nconsidered the averments made in the application and the having heard<br \/>\nlearned advocate for the applicant and also gone through the<br \/>\ncertificate issued by Dr.Mahendra L. Patel, M.B.B.S. M.R.S.M.<br \/>\n(London) of Arzoo (Pramukh) Hospital, Bhatar, Surat the applicant is<br \/>\nordered to be released on temporary bail from 26.06.2011 to<br \/>\n30.06.2011 on his furnishing personal bond for an amount of<br \/>\nRs.5,000\/- (Rupees Five Thousand Only) to the satisfaction of the<br \/>\njail authority and on usual conditions. On completion of the said<br \/>\nperiod the applicant shall surrender himself before the concerned<br \/>\nJail Authorities on 01.07.2011.\n<\/p>\n<p>5.<br \/>\n  Application is partly allowed and is accordingly disposed of. Rule<br \/>\nis made absolute to the aforesaid extent.
