              Heard both sides.\n<\/p>\n
                            Rule confined to question of sentence.\n<\/p>\n
                            Learned APP waives notice on behalf of the State.<\/p>\n
                            With the consent of parties, the application is being<\/p>\n
                 disposed of at the admission stage itself.<\/p>\n
                            Petitioner was put on trial vide Tr. No. 1598 of 2010<\/p>\n
                 for the charge(s) punishable under Sections 25(1-B)A and 26(i)<\/p>\n
                 of the Arms Act in respect of an occurrence that was committed<\/p>\n
                 on 17.11.1998. As per the prosecution case, petitioner was<\/p>\n
                 found possessed with one country made pistol and few<\/p>\n
                 cartridges. The Trial Court by judgment and order dated<\/p>\n
                 6.10.2010 found him guilty under both the charges and<\/p>\n
                 sentenced to undergo rigorous imprisonment for two and a half<\/p>\n
                 years and two years under Sections 25(1-B)A and 26(i) of the<\/p>\n
                 Arms Act respectively. He was also fined under both the heads<\/p>\n
                 with default clause.\n<\/p>\n
                            Aggrieved over by the said judgment of conviction,<\/p>\n
                 he preferred Criminal Appeal being Cr. Appeal No. 38\/2010.<\/p>\n
                 Learned Appellate Court reappraised the evidence on record<\/p>\n
                 and concluded that       based on the materials on record,<\/p>\n
                 conviction under Section 26(i) of the Arms Act was not
\n                      -2-<\/span><\/p>\n
sustainable. Accordingly, conviction recorded by the Trial Court<\/p>\n
under Section 26(i) was set aside. So far as conviction and<\/p>\n
sentence recorded under Section 25(1-B)A is concerned,<\/p>\n
learned Appellate Court did not interfere therewith. Accordingly,<\/p>\n
the appeal was allowed in part. Aggrieved by the aforesaid<\/p>\n
judgment and order, the present revision application has been<\/p>\n
preferred.\n<\/p>\n
             Learned counsel for the petitioner submits that the<\/p>\n
trial in the present case consumed more than 12 years. For all<\/p>\n
these years, he had to undergo the rigours of trial. Fighting<\/p>\n
criminal litigation for a long time has telling effects on the<\/p>\n
mental, economical and physical condition of a litigant.<\/p>\n
Referring to the judgment of the Trial Court, it is submitted that<\/p>\n
no past conviction was found and recorded. Learned counsel<\/p>\n
points out from the Trial Court judgment that a submission was<\/p>\n
advanced in the said Court that petitioner is the sole bread<\/p>\n
earner in the family. It is thus submitted that considering the<\/p>\n
aforesaid facts appearing from record, petitioner deserves a<\/p>\n
lesser sentence.\n<\/p>\n
             Learned A.P.P., on the other hand, submits that<\/p>\n
there is\/are concurrent findings of guilt recorded by the two<\/p>\n
Courts below. So far as conviction under Section 25(1-B)A<\/p>\n
is\/are concerned, this Court may not interfere with those<\/p>\n
findings. With regard to the delay in concluding the trial, learned<\/p>\n
A.P.P. concedes that the trial in the present case consumed
\n                             -3-<\/span><\/p>\n
      more than 12 years.\n<\/p>\n
                   Having considered the submissions advanced on<\/p>\n
      behalf of the parties and after going through the materials on<\/p>\n
      record including two judgments, this much is evident that the<\/p>\n
      trial of the petitioner consumed more than 12 years. Petitioner<\/p>\n
      must have undergone several excruciating circumstances for all<\/p>\n
      these years. It is further seen from the Trial Court judgment that<\/p>\n
      no previous conviction was found and recorded. It is also<\/p>\n
      gathered from the Trial Court’s judgment that a submission was<\/p>\n
      advanced before the said Court that the petitioner is the sole<\/p>\n
      bread earner in the family. Petitioner must be fairly aged. Trial<\/p>\n
      Court, while convicting him recorded his age as 45 years. In<\/p>\n
      view of these facts appearing from record, I am satisfied that a<\/p>\n
      lenient view, in so far as sentence for the proven charge is<\/p>\n
      concerned, shall sub-serve the cause of justice.<\/p>\n
                   Accordingly, while upholding the conviction recorded<\/p>\n
      under Section 25(1-B)A, the sentence awarded therein is<\/p>\n
      reduced to rigorous imprisonment for one and a half years .<\/p>\n
      Other part\/condition(s) of the sentence shall remain in<\/p>\n
      tact\/untouched.\n<\/p>\n
                   With this modification in sentence, the application is<\/p>\n
      dismissed.\n<\/p>\n<\/p>\n
