1.   This   appeal   is   directed   against   the   judgment<\/p>\n
passed by the learned Addl.Sessions Judge, Deedwana<\/p>\n
dated 10.4.2003, whereby he has convicted the accused<\/p>\n
appellant Purna Ram of the offence u\/s.366A IPC and<\/p>\n
sentenced him to undergo seven years’ R.I. together<\/p>\n
with a fine of Rs.500\/- & in default, to further undergo<\/p>\n
three months’ R.I. Accused Purna Ram has also been
\n                                      2<\/span><\/p>\n
convicted of the offence u\/s.376 IPC and sentenced to<\/p>\n
undergo       life   imprisonment         together   with   a    fine     of<\/p>\n
Rs.500\/- & in default, to further undergo three months’<\/p>\n
R.I.\n<\/p>\n<\/p>\n
2.      The charge against the accused appellant Purna<\/p>\n
Ram was that on 11.4.02, when Poonam aged 5 years,<\/p>\n
daughter of complainant Gopal Lal, was playing outside<\/p>\n
the house, he took her in the field and committed rape<\/p>\n
with her and thereafter she was sent back by giving ice<\/p>\n
cream and one & half rupee. The wife of complainant<\/p>\n
noticed       the    panty   of   the    girl   Poonam    being        blood<\/p>\n
stained and on being asked, she narrated the whole<\/p>\n
incident to her mother. The report of the incident was<\/p>\n
lodged on 16.4.02 by Gopal Lal, father of the girl, at<\/p>\n
the Police Station, Khunkhuna. Upon this, a case under<\/p>\n
ss.366A & 376 IPC was registered against the accused<\/p>\n
and investigation was commenced. After investigation,<\/p>\n
the     accused       appellant    was     chargesheeted         for     the<\/p>\n
abovesaid offences. The case was committed to the<\/p>\n
court    of    Sessions,     where       the    charges   were    framed<\/p>\n
accordingly against the accused, to which he pleaded<\/p>\n
not guilty. The prosecution examined 14 witnesses. The<\/p>\n
statement of the accused was recorded u\/s.313 CrPC.
\n                                     3<\/span><\/p>\n
He led no defence. After hearing the arguments, the<\/p>\n
learned trial Judge convicted & sentenced the accused<\/p>\n
appellant as above.\n<\/p>\n<\/p>\n
3.      The incident of rape narrated by the girl Poonam<\/p>\n
has been brought on record by the evidence of her<\/p>\n
father Gopal Lal PW 1, Smt.Kevki, PW 2 who is grand<\/p>\n
mother of the prosecutrix and also by Sharda, PW 4,<\/p>\n
her mother to whom she narrated the story. Though the<\/p>\n
girl has not been examined by the prosecution being a<\/p>\n
child    of   5   years   but the       factum    of rape    has been<\/p>\n
corroborated by the medical evidence of Dr.Anil Kumar<\/p>\n
Sharma, PW 10 and also by the investigating officer<\/p>\n
Ramdev, PW 12, when she was questioned by him.<\/p>\n
Learned counsel for the accused appellant submits that<\/p>\n
in this case, the prosecutrix has not been examined<\/p>\n
being 5 years of age and if this Court finds that the<\/p>\n
case is made out against the accused on the basis of<\/p>\n
the evidence of her father, mother and grand mother<\/p>\n
supported by the testimony of Dr.Anil Kumar Sharma,<\/p>\n
PW 10 and investigating Officer Ramdev, PW 12, then<\/p>\n
he   does     not   want    to   question        the   legality   of   the<\/p>\n
conviction and submits that he may be awarded lesser<\/p>\n
sentence because accused appellant Purna Ram is a
\n                                    4<\/span><\/p>\n
young boy of less than 25 years of age. That apart, he<\/p>\n
has been languishing in jail for last more than seven<\/p>\n
years, which is minimum punishment provided under<\/p>\n
the law.\n<\/p>\n<\/p>\n
4.   It is true that in this case, the FIR has been lodged<\/p>\n
by the delay of five days and the prosecutrix being of<\/p>\n
the age of five years, has not been examined but from<\/p>\n
the evidence of her father, mother and grand mother,<\/p>\n
there does not appear to be any reason to disbelieve<\/p>\n
their testimony, as there was no enmity or other reason<\/p>\n
to   falsely    implicate        the   accused      appellant   for<\/p>\n
committing     rape   with   a    minor girl, as held      by the<\/p>\n
learned trial Judge on the basis of the prosecution<\/p>\n
evidence as also the medical evidence.<\/p>\n
5.   So far as the sentence part is concerned, there<\/p>\n
also seems no special or adequate reasons to award the<\/p>\n
lesser sentence than provided-for under the law, which<\/p>\n
is ten years, in the       case covered under Clause (f) of<\/p>\n
sub-section    (2)    of   Section     376   IPC.   However,    the<\/p>\n
sentence of life imprisonment appears to be excessive<\/p>\n
in view of the fact that the accused appellant being<\/p>\n
village labourer and young boy of 24 years of age at the
\n                                  5<\/span><\/p>\n
time of commission of offence having long life to lead,<\/p>\n
we,   therefore,    deem    it   proper     that   the    minimum<\/p>\n
sentence provided under Section 376(2) for committing<\/p>\n
rape with a minor girl of less than 12 years, which is<\/p>\n
ten years, will suffice the ends of justice.<\/p>\n
6.    Accordingly, we allow this appeal in part. While<\/p>\n
maintaining the conviction & sentence of the accused<\/p>\n
appellant Purna Ram of the offence u\/s.366A IPC with<\/p>\n
seven years’ R.I. alongwith a fine of Rs.500\/- & in<\/p>\n
default, to further undergo three months’ R.I. recorded<\/p>\n
by the learned Addl.Sessions Judge Deedwana vide his<\/p>\n
judgment dt.10.4.03, we reduce the sentence of life<\/p>\n
imprisonment u\/s.376 IPC to ten years’ R.I., which is<\/p>\n
minimum sentence, provided under the law. However,<\/p>\n
the   amount   of   fine   of    Rs.500\/-    on    this   count   is<\/p>\n
maintained, in default of which he will further undergo<\/p>\n
three months’ R.I. Both the substantive sentences shall<\/p>\n
run concurrently.\n<\/p>\n
