SINGH, JUDGE    \nDate : 04\/12\/2008\n:J U D G M E N T: \n<\/pre>\n<p>______________________________________________________________________________________<br \/>\nPetitioners-plaintiffs have filed this Revision Petition questioning<br \/>\nAdditional District Judge, Jammu&#8217;s order of August 16, 2007 dismissing their<br \/>\napplication under Order 41 Rule 27 of the Code of Civil Procedure whereby<br \/>\nthey had sought permission for one of the appellants to appear as witness in<br \/>\nthe case which, according to them, they could not do because of the<br \/>\ninexperience and inadvertence of the counsel they had engaged in the trial<br \/>\ncourt.\n<\/p>\n<p>Petitioners&#8217; learned counsel, Shri Bachan Lal Kalgotra, submits that<br \/>\nbeing rustic villagers, the petitioners had gone by the advice of their counsel<br \/>\nin not appearing as their own witness during the trial of the case because the<br \/>\n<span class=\"hidden_text\">2<\/span><br \/>\ncounsel was under a misconception that the statement which one of them had<br \/>\nmade in the suit when the respondents had been set ex-parte would survive for<br \/>\nconsideration by the court despite lifting of ex-parte proceedings against the<br \/>\nrespondents, And that interest of justice would warrant providing an<br \/>\nopportunity to the appellants to substantiate their claim to the property in<br \/>\ndispute by appearing as a witness in the case.\n<\/p>\n<p>Per contra, Shri R. P. Sharma, submitted that petitioners had taken<br \/>\nnumerous opportunities to produce their evidence in the case and their nonappearance,<br \/>\nbeing intentional, no further opportunity could be allowed to<br \/>\nthem to fill up the lacunae they had intentionally left in the case, and<br \/>\nadditionally because the provisions of Order 41 Rule 27 of the Code of Civil<br \/>\nProcedure may not permit allowance of additional evidence.<br \/>\nI have considered the submissions made at the Bar.\n<\/p>\n<p>Powers of the Appellate Court to pass orders for production of<br \/>\ndocuments or allowance of other evidence, is circumscribed for its exercise<br \/>\nonly in three situations contemplated by Order 41 Rule 27 of the Code of<br \/>\nCivil Procedure. For exercising its jurisdiction under Order 41 Rule 27 of<br \/>\nCPC, the Appellate Court is thus required to arrive at a finding about the<br \/>\nexistence of one or the other contingencies contemplated by three clauses of<br \/>\nOrder 41 Rule 27 CPC.\n<\/p>\n<p>Conditions precedent for application of the provisions of Order 41 Rule<br \/>\n27 (1) (a) and (1) (aa) are, however, different from those of Order 41 Rule 27<br \/>\n(1) (b) CPC. In cases where provisions of Order 41 Rule 27 (a) CPC are<br \/>\ninvoked, the appellant seeking production of additional evidence will have to<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\nsatisfy the Court that the Court from whose decree the appeal has been<br \/>\npreferred had refused to admit evidence which should have been admitted. In<br \/>\nthose cases where the provisions of Order 41 Rule 27 (1) (aa) CPC are<br \/>\ninvoked, the appellant seeking permission to produce additional evidence will<br \/>\nhave to establish that notwithstanding exercise of due diligence, the evidence<br \/>\nwhich he wants to adduce, was not within his knowledge or could not, after<br \/>\nexercise of due diligence be produced by him during the currency of the suit.<br \/>\nOn the other hand, when resort is contemplated to the provisions of<br \/>\nOrder 41 Rule 27 (1) (b) of CPC, the Appellate Court is required under law to<br \/>\nconsider the entire evidence on record and thereafter come to an independent<br \/>\nfinding as to whether or not any document which is sought to be produced by<br \/>\nthe appellant or any witness(s) proposed to be examined by the appellant, was<br \/>\nnecessary for the Appellate Court, to pronounce judgment. Power under<br \/>\nOrder 41 Rule 27 (b) of CPC may also be exercised by the Appellate Court in<br \/>\ncase it finds any other substantial cause, to permit production of additional<br \/>\nevidence.\n<\/p>\n<p>Perusal of petitioners&#8217; application indicates that the case projected by<br \/>\nthe petitioners in their application was not covered by the contingencies<br \/>\ncontemplated either by Rule 27 (1) (a) or Rule 27 (1) (aa) of Order 41 CPC.<br \/>\nThe case which the petitioners had set up in their application was rather based<br \/>\non one of the grounds which they had projected in their memo of appeal<br \/>\nwhich, for facility of reference reproduced hereunder:-<br \/>\n&#8220;&#8230;..The facts on record reveal that the plaintiffs&#8217; intention<br \/>\nwas never to avoid witness box. The fact of the matter is that<br \/>\none of the plaintiffs had appeared as a witness and his<br \/>\nstatement was recorded when the case was proceeding exparte.<br \/>\nAnd then the ex-parte proceedings were set aside and<br \/>\nthe plaintiffs proceeded further to lead evidence in the case<br \/>\n<span class=\"hidden_text\">4<\/span><br \/>\nand inadvertently the counsel for the plaintiffs in the<br \/>\nmuffacil did not produce any plaintiff against as witness<br \/>\nunder the bonafide and honest impression that one of the<br \/>\nplaintiff has appeared, of course, without visualizing the<br \/>\nlegal technicalities that the statement of a witness examined<br \/>\nduring separate proceedings may or may not be read in<br \/>\nevidence.\n<\/p>\n<p>However, the plaintiffs are ready and prepared to appear in<br \/>\nthe case to face cross-examination of the<br \/>\ndefendant\/respondents if the Hon&#8217;ble Court provides an<br \/>\nopportunity to the appellants\/plaintiffs to be heard. And as<br \/>\nappellate court has unfettered powers under rule 27 order<br \/>\n41 of the rules and particularly under section 151 CPC to<br \/>\npermit a party to an appeal to lead additional evidence.<br \/>\nHowever, the objection that the appellants have not<br \/>\nappeared as their own witnesses in the case was never<br \/>\nraised at any stage by the respondent&#8217;s counsel, not even<br \/>\nduring final arguments. Had the counsel for respondents<br \/>\nraised the objection at that stage the appellants certainly<br \/>\nwould have applied to the learned trial court under section<br \/>\n151 CPC to permit the appellants or any one of them to<br \/>\nagain appear in the witness box. The learned trial Judge has<br \/>\ntaken the appellants by surprise by invoking this almost<br \/>\nsole ground to dismiss the case of the plaintiffs and thus<br \/>\npunishing the plaintiffs without any dereliction or negligence<br \/>\non their part.&#8221;\n<\/p>\n<p>As the case projected by the petitioners seeking permission to lead<br \/>\nadditional evidence was infact one of the grounds which they had projected in<br \/>\nthe memo of appeal so the right course available to the Ist Appellate Court<br \/>\nwas to consider petitioners&#8217; application at the time of consideration of the<br \/>\nappeal itself for final disposal. This is so because it is only at the stage of<br \/>\nconsideration of the appeal that the Appellate Court would be in a better<br \/>\nposition to dwell on the plea which the petitioners had projected seeking<br \/>\npermission to lead additional evidence. Such permission could be considered<br \/>\nfor its grant or refusal only if the Appellate Court had required any witness to<br \/>\nbe examined to enable it to pronounce judgment in the case or if it otherwise<br \/>\nfound, any substantial cause to have been made out by the petitioners for<br \/>\nallowing them to appear as their own witness in the case.<br \/>\nPetitioners-plaintiffs&#8217; application has been rejected by learned<br \/>\nAdditional District Judge, Jammu on the grounds that Order 41 Rule 27 CPC<br \/>\nwould not permit filling up of any lacunae or gap in the evidence which the<br \/>\n<span class=\"hidden_text\">5<\/span><br \/>\npetitioners, by omitting to appear as their own witness, had left in the case<br \/>\nand that the application was belated because of its having been filed after<br \/>\nabout two years of filing of the appeal.\n<\/p>\n<p>In view of the above discussion, it is thus apparent that the Ist<br \/>\nAppellate Court had erred in rejecting petitioners&#8217; application on the ground<br \/>\nthat it had been filed belatedly. This is so because the plea which the<br \/>\npetitioners had projected for the second time in the application under Order<br \/>\n41 Rule 27 CPC stood already raised by them in so many words in their<br \/>\nmemo of appeal. Rejection of petitioners&#8217; application on the ground of delay<br \/>\ncannot, thus, be justified.\n<\/p>\n<p>As appellants&#8217; application was not covered by the contingencies<br \/>\ncontemplated by Order 41 Rule 27 (1) (a) and (aa) so the Appellate Court was<br \/>\nrequired to consider it at the time when it had to take up the appeal for<br \/>\nhearing on its merits. It has committed an error apparent on the face of record<br \/>\nin dismissing petitioners&#8217; application without going through the merits of the<br \/>\ncontroversy raised in the suit. The order passed by the Ist Appellate Court<br \/>\ncannot, therefore, sustain.\n<\/p>\n<p>For all what has been said above, allowing this Revision Petition,<br \/>\nAdditional District Judge, Jammu&#8217;s order of August 16, 2007 rejecting<br \/>\npetitioners&#8217; application is, accordingly, set aside and it is directed that the Ist<br \/>\nAppellate Court shall take up the petitioners&#8217; appeal for consideration along<br \/>\nwith their application seeking production of additional evidence and pass<br \/>\nappropriate orders in view of the provisions of Order 41 Rule 27 of the Code<br \/>\n<span class=\"hidden_text\">6<\/span><br \/>\nof Civil Procedure as may be warranted under law after hearing the parties on<br \/>\nthe appeal and the application.\n<\/p>\n<p>( J.
