JUSTICE DINESH MAHESHWARI\n\nMr.H.K.Jain for the appellant\nMr.T.Gupta for the respondent\n                              .....\n\n         The matter has been listed in default category for initial\ncharges having not been deposited for preparation of paper-\nbook.\n         Though preparation of paper-book is not necessary in\nview of the order dated 02.09.2008 as passed in CFA No.\n617\/2005: Bhagwan Singh Vs. Makkhan Singh, however,\nlearned counsel for the defendant-appellant submits on\ninstructions that this appeal has become infructuous inasmuch\nas although preliminary decree was passed in the instant suit\nfor redemption of mortgage as filed by the plaintiff-respondent\nbut thereafter, the respondent has executed sale deed of the\nsuit property at the instructions of the appellant in favour of\nthe wife of the appellant and now, for the title of the suit\nproperty having been conveyed by the respondent in favour of\nthe appellant's wife, the decree in question         is practically\nrendered redundant. Learned counsel for the respondent has\nalso admitted the fact that the respondent has conveyed the\ntitle.\n         In view of   the submissions of learned counsel for the\nparties, this appeal is dismissed as infructuous.
