SHAH\n\t\t\n\t\n\n \n\nDate\n: 19\/03\/2009 \n\n \n\n \n \n\n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioner has prayed for an appropriate Writ, direction and\/or<br \/>\norder quashing and setting aside the impugned order dated 24.01.2005<br \/>\npassed below Exh.4 in Eviction Appeal No.72 of 2004 as well as order<br \/>\ndated 31.05.2004 passed in Eviction Case No.32 of 1984.\n<\/p>\n<p>2.\t\tIt<br \/>\nis not in dispute that there is no valid license in favour of the<br \/>\npetitioner and therefore, the petitioner has no right to continue to<br \/>\noccupy stall. Be that as it may. Mr.Ashish Dagli, learned Advocate<br \/>\nappearing on behalf of the respondent   Corporation has stated at<br \/>\nthe Bar that fresh tenders are already invited in which the<br \/>\npetitioner has also participated and submitted his offer and final<br \/>\ndecision is to be taken by the respondent   Corporation.\n<\/p>\n<p>3.\t\tMr.Vaghela,<br \/>\nlearned Advocate appearing on behalf of the petitioner has submitted<br \/>\nthat let the Corporation take appropriate decision on the basis of<br \/>\noffers already received by them and till then the petitioner be<br \/>\ncontinued to occupy the stall. It is submitted that if ultimately it<br \/>\nis found that somebody else is the highest offerer for stall and<br \/>\nlicense is given to somebody else, in that case, the petitioner shall<br \/>\nvacate the stall within a period of 2 (two) weeks thereafter. Let the<br \/>\npetitioner file Undertaking to the aforesaid effect within a period<br \/>\nof 10 (ten) days from today.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of above, present Special Civil Application is disposed of by<br \/>\ndirecting the respondent   Corporation to complete entire process<br \/>\nof allotment of stall and take appropriate decision within a period<br \/>\nof 4(four) weeks from today positively and without fail. Until then<br \/>\nthe petitioner is permitted to occupy the stall without any right<br \/>\nwhatsoever in favour of the petitioner; only by way of interim<br \/>\narrangement and till final decision is taken by the respondent<br \/>\nCorporation within stipulated time as stated herein above.  If<br \/>\nultimately it is found that the petitioner is not the highest offerer<br \/>\nand somebody else is found to be highest offerer and stall is alloted<br \/>\nto some other person, in that case, the petitioner shall vacate the<br \/>\nstall and hand over peaceful and vacant possession to the respondent<br \/>\n  Corporation within a period of 2(two) thereafter. Necessary<br \/>\nUndertaking to be filed by the petitioner that he will hand over<br \/>\npeaceful and vacant possession of the stall to the respondent<br \/>\nCorporation within a period of 2(two) weeks from final decision (in<br \/>\ncase the petitioner is not found highest offerer) within a period of<br \/>\n10(ten) days, failing which interim protection given to the<br \/>\npetitioner shall stand vacated automatically.
