BASANT, J.\n\n                      - - - - - - - - - - - - - - - - - - - - - -\n\n                         B.A.No.  964  of   2008\n\n                      - - - - - - - - - - - - - - - - - - - - - -\n\n              Dated this the 19th day of  February, 2008\n\n\n                                   O R D E R\n<\/pre>\n<p>       Application   for   anticipatory   bail.     The   petitioner   faces<\/p>\n<p>allegations   of   commission   of     offences   punishable   under   the<\/p>\n<p>Arms Act.   The Forest officials allegedly searched the premises<\/p>\n<p>in the possession of the petitioner and recovered various articles.<\/p>\n<p>In   respect   of   the   articles   which   offend   the   Forest   Act,<\/p>\n<p>proceedings   are   continuing   under   the   Forest   Act.     But   in   the<\/p>\n<p>course   of   such     search     they   came   across   what   is   described   as<\/p>\n<p>&#8220;parts of a gun&#8221;.  The same was taken into custody by the  forest<\/p>\n<p>officials,   but   as   they   were   unable   to   investigate   into   the   said<\/p>\n<p>offence under  the  Arms Act,  a report  was  submitted  before  the<\/p>\n<p>police,   on   the   basis   of   which   this   crime   has   been   registered<\/p>\n<p>alleging   commission   of   the   offence   under   the   Arms   Act.<\/p>\n<p>Investigation is in progress. The petitioner apprehends imminent<\/p>\n<p>arrest.\n<\/p>\n<\/p>\n<p>       2.   The learned counsel for the petitioner   submits that the<\/p>\n<p>allegations even if accepted in toto, cannot justify any indictment<\/p>\n<p>B.A.No.  964  of   2008<\/p>\n<p><span class=\"hidden_text\">                                             2<\/span><\/p>\n<p>for   any offence under the Arms Act.   Even a cursory reading of the<\/p>\n<p>F.I.R. must convince this Court that what is seized is not  a serviceable<\/p>\n<p>fire arm  and  is  only    discarded   and  useless  parts  of  a fire   arm.   The<\/p>\n<p>learned counsel in these circumstances submits that the petitioner does<\/p>\n<p>not deserve to suffer the trauma of arrest and incarceration on the basis<\/p>\n<p>of such allegations.\n<\/p>\n<\/p>\n<p>       3.     The   learned   Prosecutor   was   requested   to   read   over   to   this<\/p>\n<p>Court  the description of the fire arm allegedly seized.   The same has<\/p>\n<p>been read over to me.  What is recovered is a part of a gun rusted also.<\/p>\n<p>I   shall   not   embark   on   any   detailed   discussion     on   merits   about   the<\/p>\n<p>acceptability   of   the     allegations   now.     Suffice   it   to   say   that   I   am<\/p>\n<p>satisfied   that   anticipatory   bail   can   be   granted   to   the   petitioner.   The<\/p>\n<p>learned   Prosecutor   fairly   does   not   oppose   the   application.   Subject   to<\/p>\n<p>appropriate   conditions,   anticipatory   bail   can   be   granted   to   the<\/p>\n<p>petitioner, I am satisfied.\n<\/p>\n<\/p>\n<p>         4.  In the result:\n<\/p>\n<p>\n       (1)  This application is allowed.\n<\/p>\n<p>\n       (2)     The   following   directions   are   issued   under   Section   438<\/p>\n<p>B.A.No.  964  of   2008<\/p>\n<p><span class=\"hidden_text\">                                              3<\/span><\/p>\n<p>Cr.P.C.\n<\/p>\n<\/p>\n<p>       (a)   The petitioner shall surrender before the learned Magistrate<\/p>\n<p>on   26.2.2008   at   11   a.m.     The   learned   Magistrate   shall   release   the<\/p>\n<p>petitioner on regular bail   on   condition that   he executes a bond   for<\/p>\n<p>Rs.25,000\/-   (Rupees twenty five  thousand  only)  with  two  solvent<\/p>\n<p>sureties   each   for   the   like   sum   to   the   satisfaction   of   the   learned<\/p>\n<p>Magistrate.\n<\/p>\n<\/p>\n<p>       (b)  The petitioner shall make himself available for interrogation<\/p>\n<p>before   the   Investigating   Officer   between   10   a.m.   and   3   p.m.   on<\/p>\n<p>27.2.2008   and   thereafter   as   and   when   directed   by   the   Investigating<\/p>\n<p>Officer in writing to do so.\n<\/p>\n<\/p>\n<p>       (c)     If   the   petitioner   does   not   appear   before   the   learned<\/p>\n<p>Magistrate as directed in clause (1) above, these directions shall lapse<\/p>\n<p>on   26.2.08   and   the   police   shall   be   at   liberty   thereafter   to   arrest   the<\/p>\n<p>petitioner and deal with him  in accordance with law.<\/p>\n<p>       (d)   If   the   petitioner   were   arrested   prior   to   his   surrender   on<\/p>\n<p>26.2.2008  as  directed in  clause (1) above, he shall be released on bail<\/p>\n<p>B.A.No.  964  of   2008<\/p>\n<p><span class=\"hidden_text\">                                     4<\/span><\/p>\n<p>on   his   executing   a   bond   for   Rs.25,000\/-   without   any   surety<\/p>\n<p>undertaking to appear before the learned Magistrate on 26.2.2008.<\/p>\n<p>                                                (R.
