JOSEPH FRANCIS, JJ.\n             - - - - - - - - - - - - - - - - - - - - - - - - - -\n                W.P.(C).No. 17918 of 2010 L\n             - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 15th day of June, 2010\n\n                            JUDGMENT\n<\/pre>\n<p>Joseph, J.\n<\/p>\n<p>      The petitioner has approached this court seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>               i) issue a writ of mandamus or any<\/p>\n<p>         other    appropriate         writ      or     direction<\/p>\n<p>         directing the 2nd respondent to provide<\/p>\n<p>         adequate,      sufficient        and      meaningful<\/p>\n<p>         protection to the life of the petitioner and<\/p>\n<p>         other co-owners of the temple and for the<\/p>\n<p>         construction of a compound wall around<\/p>\n<p>         the   Palakkad         Vadavannur            Koundan<\/p>\n<p>         Kulambu Mariamman Kovil (Temple).<\/p><\/blockquote>\n<p>               ii) issue a writ of mandamus or any<\/p>\n<p>         other    appropriate         writ      or     direction<\/p>\n<p>         directing the 2nd respondent to take<\/p>\n<p>W.P.(C).No. 17918 of 2010<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>         immediate and effective steps\/action pursuant<\/p>\n<p>         to Exts.P2 and P3 in accordance with law.<\/p>\n<p>      2. Briefly the case of the petitioner is as follows. The<\/p>\n<p>petitioner is one of the co-owners of the Palakkad, Vadavannur<\/p>\n<p>IKoundan Kulamby Mariyamman Kovil, which is a family temple<\/p>\n<p>and the administration of the temple is managed by the owners of<\/p>\n<p>the temple. No other persons have any role in the management of<\/p>\n<p>the temple. O.S.125 of 2010 is pending before the Munsiff Court,<\/p>\n<p>Chittoor, in which an interim order was also passed.<\/p>\n<p>      3.   At present some persons under the leadership of<\/p>\n<p>respondents 3 to 5 are forcefully entering the temple premises and<\/p>\n<p>using the temple premises for illegal activities.       They have<\/p>\n<p>destroyed the fencing of the temple. The temple authorities<\/p>\n<p>decided to construct a compound wall.          It is submitted that<\/p>\n<p>respondents 3 to 5 are threatening the petitioner.<\/p>\n<p>W.P.(C).No. 17918 of 2010<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>     4.   We heard learned counsel for the petitioner and the<\/p>\n<p>learned Government Pleader.\n<\/p>\n<p>     5. Learned Government Pleader, on instructions, submits that<\/p>\n<p>there is a claim of way. In such circumstances it may not be<\/p>\n<p>appropriate for this court to entertain the matter. We decline to<\/p>\n<p>entertain the writ petition and we relegate the petitioner to<\/p>\n<p>approach the appropriate forum seeking appropriate relief. We<\/p>\n<p>make it clear that if the petitioner  complains of commission of<\/p>\n<p>any cognizable offence by respondents 3 to 5, the second<\/p>\n<p>respondent shall take appropriate action in accordance with law.<\/p>\n<p>                                      (K.
