DESHPANDE, J. <\/p>\n<p>1. Heard Mr. Tripathi for the petitioner &#8211;<br \/>\ndetenu and Mr. B.R. Patil, Acting P.P. for<br \/>\nthe State.\n<\/p>\n<p>2. The detenue is detained under Section 3(1)<br \/>\nof the Maharashtra Prevention of Dangerous<br \/>\nActivities of Slumlords, Bootleggers, Drug<br \/>\nOffenders and Dangerous Persons Act, 1981. The<br \/>\ndetention order is dated 17.8.2002. Grounds of<br \/>\ndetention are of the same date. The detention is<br \/>\nbased on one C.R. and two in-camera statements.<br \/>\nIn the petition number of grounds have been<br \/>\nraised but Mr. Tripathi concentrated on ground<br \/>\n(J) and since we are allowing the petition on<br \/>\nthat ground alone, we did not hear him on other<br \/>\ngrounds.\n<\/p>\n<p>3. As per ground (J) the detention order was<br \/>\ndated 17.8.2002. Initially the detenue refused<br \/>\nto accept the grounds of detention and other<br \/>\ndocuments. Thereafter his Advocate applied to<br \/>\nthe State Government for supplying the grounds of<br \/>\ndetention and other documents. Such an<br \/>\napplication came to be sent by the Advocate of<br \/>\nthe detenue on 23.9.2002 but the grounds of<br \/>\ndetention were served upon the detenue on<br \/>\n13.10.2002 i.e. after a lapse of about 21 days<br \/>\nand therefore according to the detenue the<br \/>\ninordinate delay in executing the order vitiate<br \/>\nthe detention because it is violative of Article<br \/>\n22(5) of the Constitution of India.\n<\/p>\n<p>4. The detaining authority as well as<br \/>\nsponsoring authority filed their affidavit and<br \/>\nagain fresh affidavit dated 3.4.2003 of Mr. V.H.<br \/>\nBhasin, Sr. Inspector of Police, is filed.<br \/>\nIn all the affidavits filed in reply to this<br \/>\nparticular allegation attempt is made to explain<br \/>\nthe delay. However it is a fact that the<br \/>\nGovernment passed order of supplying copies on<br \/>\n19.09.2002 and not on 23.9.2002 as stated by the<br \/>\nPetitioner-detenue in ground (J); and the<br \/>\ndocuments came to be served upon the detenue on<br \/>\n9.10.2002. In the affidavit in reply it has been<br \/>\nstated that because the detenue has refused to<br \/>\naccept the documents initially, every authority<br \/>\nthereafter went through all the documents, papers<br \/>\nand grounds of detention carefully and the papers<br \/>\nwere further processed by the officer who was in<br \/>\ncharge of the file but the detaining authority<br \/>\nwas at Delhi between 1.10.2002 to 6.10.2002 and<br \/>\ntherefore there was delay.\n<\/p>\n<p>5. Mr. Patil stated that firstly there is<br \/>\nno delay in serving the documents upon the<br \/>\ndetenue and secondly delay between 19.9.2002 and<br \/>\n9.10.2002 is properly explained in the<br \/>\naffidavits.\n<\/p>\n<p>6. We are not at all satisfied by the<br \/>\naffidavits filed by the authorities in this<br \/>\nregard. It is an admitted fact that when the<br \/>\ndetention order was passed on 17.8.2002 all the<br \/>\ndocuments including grounds of detention and<br \/>\ncompilation were ready and they were merely to be<br \/>\nserved upon the detenue. Even if the detenue<br \/>\nrefused service of the documents but when his<br \/>\nadvocate applied for supplying him the documents<br \/>\nwhat was required was mere tender of the set to<br \/>\nthe detenue and nothing new was to be prepared<br \/>\nnor was there any necessity of processing the<br \/>\ndocument and application of mind. It was not a<br \/>\nquestion of changing the documents or changing<br \/>\nthe detention order or charging the grounds of<br \/>\ndetention. The legal formality was required to<br \/>\nbe completed in respect of service of the<br \/>\ndocuments which were prepared or were ready on<br \/>\nthe date and at the time of signing of the<br \/>\ndetention order on 17.8.2002. Therefore the<br \/>\ncontention of the detaining authority and other<br \/>\nauthorities that different authorities<br \/>\nreprocessed the documents, reconsidered them, is<br \/>\nnot at all acceptable. We find that some lame<br \/>\nattempt is made to explain the delay between<br \/>\n19.9.2002 to 9.10.2002. There is no explanation<br \/>\nat all and whatever is contended by the<br \/>\nauthorities is not acceptable in the<br \/>\ncircumstances of the case. This has resulted in<br \/>\naffecting the right of the detenue to make<br \/>\nrepresentation at the earliest point of time as<br \/>\nenvisaged under Article 22(5) of the Constitution<br \/>\nof India. Consequently the petition succeeds.<br \/>\nHence, the order:\n<\/p>\n<p> ORDER<\/p>\n<p>Petition is allowed.\n<\/p>\n<p>Rule made absolute.\n<\/p>\n<p>Order of detention dated 17.8.2002 is<br \/>\nquashed.\n<\/p>\n<p>Detenue Vilas Siddhu Jadhav be released<br \/>\nforthwith, if not required in any other case.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bombay High Court Shri Vilas Siddhu Jadhav vs Shri M.N.
