KRISHNAN, J.\n                 ...........................................\n                  M.A.C.A.NO.2727 OF 2009\n                 .............................................\n            Dated this the 26th day of May, 2010.\n\n                        J U D G M E N T\n<\/pre>\n<p>     This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Perumbavoor in OP(MV)No.748\/2006. The<\/p>\n<p>claimant is alleged to have sustained injuries in a road<\/p>\n<p>accident while a bicycle driven by him was hit on the back<\/p>\n<p>side of a Scorpio car.          He had sustained fractures and<\/p>\n<p>was admitted in a hospital.           But the court below dismissed<\/p>\n<p>the application on the ground that entire materials are not<\/p>\n<p>placed before   the court to appreciate                     the matter.  It<\/p>\n<p>appears that when he was admitted in the hospital, it was<\/p>\n<p>represented that the accident took place while the said<\/p>\n<p>person was travelling in a bike.\n<\/p>\n<p>      2. Learned counsel for the appellant showed me a<\/p>\n<p>copy of the FIR which is registered on the basis of a private<\/p>\n<p>complaint   referred under Section 156(3) of the Criminal<\/p>\n<p>Procedure Code. There the mention is of a bicycle.<\/p>\n<p>Unfortunately, it is a case where the claimant did not<\/p>\n<p>produce those documents nor did tender any evidence when<\/p>\n<p><span class=\"hidden_text\">                             : 2 :<\/span><br \/>\nM.A.C.A.NO.2727 OF 2009<\/p>\n<p>there is a dispute regarding the cause of injury.        The<\/p>\n<p>learned counsel would submit that if an opportunity is given,<\/p>\n<p>he shall produce the necessary documents and adduce<\/p>\n<p>evidence. I am inclined to grant an opportunity.<\/p>\n<p>     3. Therefore, the award under challenge is set aside<\/p>\n<p>and the matter is remitted back to the Tribunal with liberty<\/p>\n<p>to  all concerned to produce documentary as well as oral<\/p>\n<p>evidence in support of their respective contentions and then<\/p>\n<p>dispose of the matter in accordance with law. Parties are<\/p>\n<p>directed to appear before the Tribunal on 03.07.2010.<\/p>\n<p>     Disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                M.N.
