  \u00bbv thaitilr C the ‘ \u00abdf\u00e9roperties belonged to
\nKkithandaha llii “Jan Mutt?”\n<\/p>\n
The answer straiight away_woii.ld be that the lower appellate Court<\/p>\n
.—.was n_ot1:ja:s_t’i’r”ised in” “no.t.___relegating the parties to the trial Court as<\/p>\n
an adld’itio”r1_alrissue’-.arose for consideration, which had to go to<\/p>\n
trial.”{llherefore:;..V_tli:e lower appellate Court summarily allowing the<\/p>\n
amendmenttend also decreeing the suit results in the proceedings<\/p>\n

3. To briefly narrate the facts\u00bb<\/p>\n
The plaintiffs had \ufb01led a suit for permanent .ijr1juneti–on<\/p>\n
restraining the defendants from disposing of the-jsuit..sC’he’dtile V’<\/p>\n
properties. It was claimed that plaiintiffsp iyereljideyotees <\/p>\n
Ithandahalli J angarna Mutt and they areilmerniaers <\/p>\n
The suit was being presented inka”representative eapacity on<\/p>\n
behalf of the devotees ofjjppthe  Jangama
\nMutt is said to be__a braaesheiolfe Srishaila Maha
\nSamasthana,  thse  granted the suit
\npropertiesni      rnaintenance and support.\n<\/p>\n
The in’ addition to the lands given to it.\n<\/p>\n
The lands are4.une,nfra.ne’hised\ufb01with no right to dispose of the same<\/p>\n
” =  fat\/:(i’\u00ab!.1rE(_):f any persons… \u00abThe first defendanbappellant, seeking to<\/p>\n
“Sswa.iriije’eAe:of. the said Mutt did not have any right or interest<\/p>\n
in tl:ellipropel11j{_.*ilt was alleged that revenue entries and revenue<\/p>\n
d.ocumei1tS_l1were surreptitiously changed in his personal name and<\/p>\n
 _had–.m.ade an attempt to dispose of and alienate the properties,<\/p>\n
 ‘ = which warranted the filing ofgg suit.\n<\/p>\n
The first defeadant–appellant herein having entered<\/p>\n
appearance filed written statement denying the allegatia,n’s._ia-nd<\/p>\n
questioned the maintainability of the suit. While  ‘<\/p>\n
that Ithandahalli Eangama Mutt was a:~b’rai*i\u20ach of S.riil\\li’if11n1afnaG.i,<\/p>\n
Srishaila Maha Samasthana, Gulur, it was “c1_aimed’_t_hat\u00bb. inso15a1:_as._VV<\/p>\n
the suit schedule properties were””concerned;\ufb02iey}were his V<\/p>\n
personal properties and didiiot  further
\nstated that the land was not but, it was
\nInam land of   provisions of The
\nMysore(Persorial  Abolition Act, 1954,
\nthe ‘had been granted the lands and he<\/p>\n
was in posslessiion of the “s\u00bba.i.i’ie by virtue of grant of occupancy<\/p>\n
 ‘3I’__iherefore’,l”‘tbeplaintiffs had no right to question the<\/p>\n
  by the first defeadant–appel1ant.\n<\/p>\n
i’  Court after a trial held in favour of the first<\/p>\n
defendantgappellant herein, against which an appeal was preferred<\/p>\n
 _ and -inithe appeal, the piaintiffs chose to seek an amendment of the<\/p>\n

prayer to include the relief of declaration that the property did not
\nbelong to defendant. No.3, but it actually belonged to the Mutt.<\/p>\n
The same having been allowed the lower appellate Co1i:rt._ia],vso<\/p>\n
thought it fit to decree the suit without any furtheradt).   <\/p>\n
resulted in the present appeal.\n<\/p>\n
4. The learned counse1~,..for_gthe.iap_pell_ant: woiild “assert”.<\/p>\n
that the appellant was the~..absol~:1’t’e=ov.rner_of  property.<\/p>\n
Even if it could be challenged’by’jv’iirtue__.oif’tleideclaration having
\nbeen sought, the’re’fgv:a’s needafor ~.t.ri.3.l of additional issues
\nthat didlgarise.  ‘adopted by the lower appellate<\/p>\n
Court was therefore nolt’.coat_e’mplated in law and is in violation of<\/p>\n
 < the  prescrib_e_d-vln that, the lower appellate Court having<\/p>\n
 the application and also having decreed the<\/p>\n
suit ,witho;rt'iai.V_full \ufb02edged trial that was necessary to address the<\/p>\n
 l'-issues th.at'i- arose, there is no hesitation in holding that a serious<\/p>\n
 l'\u20ac"1'i"'0,r been committed by the lower appellate \ufb01ourt in<\/p>\n
  proceeding  it has. Therefore, it would not even be necessary to<\/p>\n
\u20ac<\/p>\n
frame any substantial question of law to admit the appeal and<\/p>\n
thereafter to hear the matter at length.\n<\/p>\n
5. A plain reading of the juclgrneiit y_w’louI.dl:di’sc_loVse7~’the”.<\/p>\n
error and impropriety committed. by the lower appelplate <\/p>\n
One other aspect, which would alsou’i*eVtjui.re tolbe_ addressed, is that
\nthough the suit was filed in ;._\u00a33…”iT.6pI’ie;S\u20acl1Ti\u00a3lli\\{\u20ac. Vvicapacity claiming that
\nthe property belongs to   Niiiti; the Mutt is<\/p>\n
significantly ngt  .21  _VThe  is only named as<\/p>\n
Swamiji of _that”Mutt\u00ab:.;\u00a7:houg_h   independent interest in<\/p>\n
the said ‘it is necessary to implead<\/p>\n

lsvincelitis that Ithandahalli Jangarna Mutt is only a branch<\/p>\n

6. Accordingly, the present appeal is allowed. The
\nsubstantial question of law framed is answered in favour of the<\/p>\n
appellant. The judgment and decree of the lower appellate~.C’ourt<\/p>\n
insofar as it decreed the suit is set aside. The\u00a7”auit:iT’sh’aiil<\/p>\n
remanded to the trial Court after thevanie-n.drnc’;nt the i*el_ief “of <\/p>\n
