(Oral)\n<\/pre>\n<p>1      Learned counsel for the petitioner submits that the<\/p>\n<p>department had agreed to comply with the order dated<\/p>\n<p>29.08.2011 &amp; 24.09.2011, whereby the Chief Commissioner<\/p>\n<p>of Customs was directed to hold an inquiry and take<\/p>\n<p>appropriate actions against the erring customs officials and<\/p>\n<p>intimate the court in writing.\n<\/p>\n<p>\n2      Learned counsel further submits that after passing the<\/p>\n<p><span class=\"hidden_text\">       Crl.M.C.2529\/2011                         Page 1 of 3<\/span><br \/>\n order     dated      29.08.2011;   the   department   moved   an<\/p>\n<p>application for recalling of the above mentioned orders. It is<\/p>\n<p>stated in the application that the Inquiry being conducted by<\/p>\n<p>the Investigation Officer shall be supervised by the Senior<\/p>\n<p>Officers of DRI, Delhi Zone.\n<\/p>\n<p>\n3       It is further stated that the investigation is being<\/p>\n<p>conducted from every angle.\n<\/p>\n<p>\n4       It is stated that the inquiry shall be fair and as per<\/p>\n<p>provisions of law.\n<\/p>\n<p>\n5       On instructions of Sh. Devender Singh, Investigation<\/p>\n<p>Officer of DRI, learned counsel for the petitioner assured this<\/p>\n<p>court that the direction given by the learned trial court in the<\/p>\n<p>above stated two orders shall be complied with and<\/p>\n<p>inquiry\/investigation shall be conducted by Senior officer, not<\/p>\n<p>below the rank of Joint Secretary of DRI against the erring<\/p>\n<p>Customs Officers, and the outcome of investigation shall be<\/p>\n<p>filed before the trial court.\n<\/p>\n<p>\n6       In view of above, I modify the orders dated 29.08.2011<\/p>\n<p>and 24.09.2011 passed by learned Trial Court to the extent<\/p>\n<p><span class=\"hidden_text\">        Crl.M.C.2529\/2011                       Page 2 of 3<\/span><br \/>\n that the inquiry shall be conducted as stated in para No.5<\/p>\n<p>above, within one month from today.\n<\/p>\n<p>\n7    Accordingly, Crl.M.C.3429\/2011 is partially allowed.<\/p>\n<pre>8    No order as to costs.\n\n\n9    Dasti.\n\n\nCRL.
