Respondents\n\n        Petition filed under Article 226 of the Constitution of India\npraying for the relief as stated therein.\n\nFor petitioner   : No appearance\n\nFor respondents  : Mr. Abudu Kumar Rajarathinam\n            Government Advocate (Crl. side)\n:O R D E R\n<\/pre>\n<p>(Order of the Court was delivered by S.ASHOK KUMAR,J.)<br \/>\n        The wife of the detenu is  the  petitioner  herein  and  he  has  come<br \/>\nforward  to  file the above petition praying to issue a Writ of Habeas Corpus,<br \/>\ncalling  for  the  records  relating  to  the  order  in  C2\/53962\/2003  dated<br \/>\n20.10.2003  passed  by the second respondent herein, quash the same as illegal<br \/>\nand further direct the respondents to produce the body of the detenu viz.,Raja<br \/>\nS\/o Velu who is now confined in the Central  Prison,  Cuddalore,  before  this<br \/>\nCourt and set him at liberty forthwith.\n<\/p>\n<p>        2.   The  detenu  has  been  detained  on  the  ground  that she was a<br \/>\nBootlegger under the relevant provisions of Tamil Nadu Act 14 of 1982.\n<\/p>\n<p>        3.  Heard Mr.  Abudu Kumar Rajarathinam, learned  government  advocate<br \/>\non  the  criminal  side  with  no  representation  made  on  the  part  of the<br \/>\npetitioner.\n<\/p>\n<p>        4.  On a perusal of the records, it comes to be known that the  second<br \/>\nrespondent  has  passed  the order of detention as against the detenu branding<br \/>\nhim as a Boot-Legger on account of the threat caused  by  him  to  the  public<br \/>\norder.  It further comes to be known that already 3 cases have been registered<br \/>\nas  adverse  cases  against  the detenu, of which, one is a case under Section<br \/>\n4(1)(a)4(1)(aaa) R\/w Section 4(1-A)( ii) of T.N.P.Act 1937.\n<\/p>\n<p>        5.  It further comes to be seen from the detention order passed by the<br \/>\ndetaining authority, this Court is able to come  across  one  serious  anomaly<br \/>\nviz., non-application of mind on the part of the detaining authority exhibited<br \/>\non the part of the sponsoring authority.\n<\/p>\n<p>        6.   So far as the point regarding non-application of mind on the part<br \/>\nof the  detaining  authority  is  concerned,  in  para.6  of  the  grounds  of<br \/>\ndetention,  it  is stated by the detaining authority that there is an imminent<br \/>\npossibility of the the detenu coming  out  on  bail  for  the  offences  under<br \/>\nSection  4(1)(a),  4(1)(aaa)  r\/w  4(1-A)(ii) of TNP Act, 1 937 by filing bail<br \/>\napplications before the Court, which shows that there  is  non-application  of<br \/>\nmind  on the part of the detaining authority in stating that there is imminent<br \/>\npossibility of his coming out on bail.  Therefore, there  is  no  material  on<br \/>\nrecord to show that the detaining authority has independently applied his mind<br \/>\nwithout  taking  into consideration the statement of the sponsoring authority,<br \/>\nand hence, the order of detention gets vitiated.\n<\/p>\n<p>        7.  This Court&#8217;s attention is also drawn to a  decision  of  the  Apex<br \/>\nCourt rendered in  <a href=\"\/doc\/1453914\/\">Rivadeneyta Ricardo Agustin v.  Govt.  of Delhi<\/a> reported in<br \/>\n1994 SCC (Cri) 354, wherein it is held therein:\n<\/p>\n<p>&#8220;7.  &#8230;.\n<\/p>\n<p>8.  The above statement merely speaks  of  a  &#8220;possibility&#8221;  of  the  detenu&#8217;s<br \/>\nrelease in  case  he moves a bail petition.  It neither says that such release<br \/>\nwas likely or that it was imminent.  Evidently, the statement falls  short  of<br \/>\nthe requirement enunciated by this Court in Kamarunnissa.\n<\/p>\n<p>11.   In  these  circumstances,  we must hold that the principle enunciated by<br \/>\nthis Court in <a href=\"\/doc\/212274\/\">Kamarunnissa v.  Union of India<\/a> squarely applies and  the  order<br \/>\nis liable to be quashed.  It is accordingly quashed.&#8221;<br \/>\nFalling  in  line with the above decision of the Apex Court, since the present<br \/>\ncase is on similar set of facts and circumstances, this Court has to pass  its<br \/>\norder in the following manner :-\n<\/p>\n<blockquote><p>                In result,\n<\/p><\/blockquote>\n<blockquote><p>                (i) the above Habeas Corpus Petition is allowed;<\/p><\/blockquote>\n<p>                (ii)   the   detention   order   dated   20.10.2003   made  in<br \/>\nC2\/53962\/2003 by the second respondent herein is quashed;\n<\/p>\n<p>                (iii) the detenu, viz., Thiru.Raja S\/o Velu, is directed to be<br \/>\nset at liberty forthwith unless his detention is required in any other case.\n<\/p>\n<p>Index:Yes<br \/>\nInternet:Yes<br \/>\ngr.\n<\/p>\n<p>To\n<\/p>\n<p>1.
