JUSTICE AJAY TEWARI<\/p>\n<p>Present:     Mr. Deepak Sibal, Advocate<br \/>\n             for the petitioner.\n<\/p>\n<p>             Mr. Harish Rathee, Sr. DAG, Haryana.\n<\/p>\n<p>AJAY TEWARI J. (ORAL)<\/p>\n<p>             The petitioner has challenged the holding of disciplinary<\/p>\n<p>proceedings on the same allegations as those for which he is facing criminal<\/p>\n<p>trial. Learned counsel for the petitioner has informed me that the case has<\/p>\n<p>been fixed for framing of charges for 23.04.2009.<\/p>\n<p>             Limited prayer made by learned counsel for the petitioner is<\/p>\n<p>that the investigating officer, the shadow witness and the complainant be<\/p>\n<p>first examined in the Court so that cross examination to be conducted by the<\/p>\n<p>petitioner can be concluded and that thereafter the inquiry proceedings can<\/p>\n<p>go on.\n<\/p>\n<p>             Though learned Senior Deputy Advocate General has<\/p>\n<p>vehemently argued that even this limited prayer of the petitioner is not<\/p>\n<p>justified, yet I feel that if a time bound direction is given for the recording<\/p>\n<p>of the evidence of these witnesses, it might be in the interest of justice to<br \/>\n<span class=\"hidden_text\"> CWP No.3272 of 2009                                    -2-<\/span><\/p>\n<p>defer the disciplinary proceedings till these witnesses are examined.<\/p>\n<p>             In   the   circumstances,   the   trial    court,   Special   Judge,<\/p>\n<p>Yamunanagar is directed to finalize the proceedings regarding the framing<\/p>\n<p>of charges on 23.04.2009 itself and in case charge is framed then the three<\/p>\n<p>witnesses mentioned above would be examined on or before 26.05.2009.<\/p>\n<p>For this purpose, learned Senior Deputy Advocate General, Haryana has<\/p>\n<p>also stated that he would ensure that prosecution does not seek unnecessary<\/p>\n<p>adjournment for producing these witnesses.\n<\/p>\n<p>             The case is adjourned to 28.05.2009.
