SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/11\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tRULE.\n<\/p>\n<p> Shri Virat Popat, learned advocate waives service of notice of<br \/>\nrule on behalf of the respondents.\n<\/p>\n<p>2.\tIn<br \/>\nthe facts and circumstances of the case and with the consent of the<br \/>\nlearned advocates appearing on behalf of the respective parties, the<br \/>\npresent application is taken up for final hearing today.\n<\/p>\n<p>3.\tThe<br \/>\npresent application has been preferred by the applicant-State of<br \/>\nGujarat for fixing the early date of hearing and\/or vacating the<br \/>\ninterim relief granted by this Court.\n<\/p>\n<p>4.\tConsidering<br \/>\nthe fact that when earlier the interim relief was granted it was<br \/>\nafter hearing the learned advocates appearing on behalf of the<br \/>\nrespective parties, the prayer for vacating the interim<br \/>\nrelief\/ad-interim relief is not pressed.  However, it is requested to<br \/>\ndirect the Registry to place the main  matter for final hearing at<br \/>\nthe earliest.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and considering the nature of controversy in the main matter,<br \/>\nRegistry is directed to notify Criminal Miscellaneous Application No.<br \/>\n1097\/2008  for final hearing in the week commencing from 20\/12\/2010.\n<\/p>\n<p>6.\tWith<br \/>\nthis, the present application is allowed.
