The claim petition was filed being MACP<br \/>\n\tNo.2852\/01 by the dependent members of the family of the deceased<br \/>\n\tfor compensation of Rs.15 Lakhs.  The Tribunal ultimately, passed<br \/>\n\tthe above referred judgement and order.  It is under these<br \/>\n\tcircumstances, the present appeal before this Court.\n<\/p>\n<p>We<br \/>\n\thave heard Ms.Vasavdatta Bhatt, learned counsel appearing for the<br \/>\n\tappellant and Mr.Darji appearing for the original claimants.\n<\/p>\n<p>The<br \/>\n\tfirst contention raised by the learned counsel for the appellant is<br \/>\n\tthat there is no contributory negligence attributed by the Tribunal<br \/>\n\tto the driver of the vehicle and therefore, the error, which may be<br \/>\n\tinterfered by this Court.\n<\/p>\n<p>The<br \/>\n\texamination of the said contention with the discussion of the<br \/>\n\tevidence by the Tribunal is at para 8 of the judgement.  It appears<br \/>\n\tfrom the record that the driver of the scooter Bharatbhai Ishwarbhai<br \/>\n\tGohil has been examined at Exh.36 and as per his evidence, he was<br \/>\n\tdriving the scooter on the left side of the road, but the ST bus has<br \/>\n\tdashed with the scooter and the accident has happened.  Further, the<br \/>\n\tindependent witness Subhashbhai, Ex.71, was also examined who was<br \/>\n\thaving pan galla near to the place of incident. As per his evidence<br \/>\n\ton record, the driver of the ST Bus by driving the bus on the wrong<br \/>\n\tside, has dashed with the scooter.  There is no evidence whatsoever<br \/>\n\tled by the appellant ST Corporation nor the driver of the ST bus has<br \/>\n\tbeen examined. The damage to the vehicle, as per the panchnama is on<br \/>\n\tthe side of the bus and also on the side of the scooter.  Under<br \/>\n\tthese circumstances, if the Tribunal has found that the driver of<br \/>\n\tthe ST bus is fully responsible for the accident and  no<br \/>\n\tcontributory negligence has been attributed to the driver of the<br \/>\n\tscooter, such an approach on the part of the tribunal cannot be said<br \/>\n\tas erroneous.  Hence, the contention cannot be accepted.\n<\/p>\n<p>The<br \/>\n\tlearned counsel next contended that on the aspect of quantum, the<br \/>\n\tTribunal has committed error. She submitted that for the loss of<br \/>\n\testate, the Tribunal has wrongly awarded the amount of Rs.25,000\/-<br \/>\n\tand therefore, this Court may interfere.\n<\/p>\n<p>The<br \/>\n\texamination of the said contention shows that the deceased was<br \/>\n\temployed with the Gujarat Water Supply Corporation and his salary<br \/>\n\tslip was produced.  His net income of Rs.5070\/- per month was<br \/>\n\tconsidered and thereafter, his income at the time of requirement per<br \/>\n\tmonth was considered and the average income was found out by the<br \/>\n\tTribunal at Rs.7,389\/-.  So far as the other work is concerned, only<br \/>\n\tRs.250\/- per month for supplying milk to the society is taken into<br \/>\n\tconsideration. Thereafter, the monthly income is assessed at<br \/>\n\tRs.7640\/- per month out of which 1\/3rd is deducted<br \/>\n\ttowards personal expenses and for the purpose of compensation 2\/3rd<br \/>\n\tof the amount has been considered.  Further, keeping in view the age<br \/>\n\tof the deceased of 39 years, multiplier applied is of 12.  On the<br \/>\n\taspects of loss of estate, the amount of Rs.25,000\/- could not be<br \/>\n\tsaid to be perverse exercise of the power. Hence, the contention<br \/>\n\tthat the contention that the Tribunal has committed error on the<br \/>\n\taspects of quantum is without substance.\n<\/p>\n<p>In<br \/>\n\tview of the above, the appeal is meritless.
