The Appellants,  in this appeal under Clause X  of<br \/>\n  the  Letters Patent, have challenged the correctness of  the<br \/>\n  judgment  and  order dated 25th January, 2000 passed by  a<br \/>\n  learned  Single Judge of this Court in CW No.3517\/1996.  The<br \/>\n  learned  Single  Judge  allowed the writ petition  filed  by<br \/>\n  Respondents No.1 to 17 who are employees of the Appellants.\n<\/p>\n<p>  2.   Some time in 1968, the Appellants started a school<br \/>\n  in  the  name of  Shri   Sanatan  Dharam  Lajwanti Adarsh<br \/>\n  Vidyalaya.  The school began with primary classes but during<br \/>\n  the  year a Nursery Wing was also added.  The school was not<br \/>\n  aided by  Respondent Nos.18 or 19.  Respondents No.1 to  17<br \/>\n  joined  the Nursery Wing of the aforesaid school on  various<br \/>\n  dates from 1971 onwards.\n<\/p>\n<p>   3.   Sometime   in  1971, the   Appellants   moved   an<br \/>\n  application  for  recognition of the school including  its<br \/>\n  Nursery  Wing.   The application   was  considered  by  the<br \/>\n  Municipal  Corporation  of  Delhi (for short the  MCD).   A<br \/>\n  resolution  was passed by the Education Committee of the MCD<br \/>\n  on  20th April, 1972 granting recognition to the school  run<br \/>\n  by  the  Appellants  subject to  certain  conditions being<br \/>\n  fulfillled  by them.  It is nobody&#8217;s case that the conditions<br \/>\n  laid down were not fulfillled.\n<\/p>\n<p>  4.   There cognition  granted to the school run by  the<br \/>\n  Appellants  continued from time to time and we were told  by<br \/>\n  learned  counsel for Respondents No.1 to 17 that even today<br \/>\n  the school, including the Nursery Wing thereof is recognised<br \/>\n  under the provisions of the Delhi School Education Act, 1973<br \/>\n  (for short the Act) which came into force with effect  from<br \/>\n  27thApril, 1973.  The grievance of Respondents No.1 to  17<br \/>\n  was  that  in spite of recognition being  granted  to  the<br \/>\n  Nursery  Wing of the school run by the Appellants, they were<br \/>\n  not  being given the scales of pay and allowances granted to<br \/>\n  employees of other recognised unaided schools.  According to<br \/>\n  these Respondents,  the  Appellants were  violating   the<br \/>\n  provisions  of  Section  10 of the Act by denying  them  the<br \/>\n  appropriate scales of pay and allowances.\n<\/p>\n<p>   5.   In this background, Respondents No.1 to 17 filed CW<br \/>\n  No.3517\/1996in  this  Court wherein they  prayed  for  an<br \/>\n  appropriate  writ  of mandamus for grant of parity of wages<br \/>\n  and  other  emoluments  including conditions of  service  as<br \/>\n  applicable  to  employees of other recognised institutions.<br \/>\n  By  the  impugned  judgment and order, the  learned Single<br \/>\n  Judge allowed  the  writ petition and held  that  the  writ<br \/>\n  petitioners  were  entitled  to parity of  wages  and other<br \/>\n  emoluments as their counterparts in recognised schools.\n<\/p>\n<p>   6.   Feeling  aggrieved, the Appellants have  preferred<br \/>\n  this appeal contending, inter alia, that the Nursery Wing of<br \/>\n  the  school  run  by the Appellants is not  recognised  and,<br \/>\n  therefore,  there can be no question of parity in wages  and<br \/>\n  other emoluments in favor of Respondents No.1 to 17.\n<\/p>\n<p>   7.   We  heard  learned counsel for the parties  on  8th<br \/>\n  May, 2002 when judgment was reserved.\n<\/p>\n<p>   8.   Learned  counsel for the Appellants placed reliance<br \/>\n  on  a letter dated Nil which appears on page 80 of the paper<br \/>\n  book to contend that the Nursery Wing of the school was not<br \/>\n  recognised. As  per this letter which bears an  illegible<br \/>\n  signature  (with  no name) and is a hand  written  document<br \/>\n  purported  to be written on behalf of the MCD, it isstated<br \/>\n  that the Nursery Wing of the school run by the Appellants is<br \/>\n  not  recognised by the MCD as per the provisions of the Act.<br \/>\n  We  cannot place any credence on this letter for the reason<br \/>\n  that the  identity  of its author is not known, it  is  not<br \/>\n  known whether the author of the letter had the authority to<br \/>\n  issue it and the letter is undated.\n<\/p>\n<p>   9.   The fact of the matter is that Respondents No.1 to<br \/>\n  17  had  positively  averred that the Nursery Wing  of  the<br \/>\n  school  run  by  the Appellants is recognised  as  per  the<br \/>\n  provisions  of  the Act.  This has not been controverter  by<br \/>\n  the  Appellants  either by showing that the conditions  laid<br \/>\n  down by  the Education  Committee of the MCD  as  per  the<br \/>\n  resolution dated 20th April, 1972 were not acceptable to the<br \/>\n  Appellants or were otherwise not complied with.  Respondents<br \/>\n  No.1to 17 have placed another document on record which  is<br \/>\n  dated 20th November, 1973 which makes a reference to another<br \/>\n  resolution  No.724  dated  8th  October,  1973  whereby  the<br \/>\n  Department  of Education of the MCD has granted  recognition<br \/>\n  with aid to the school run by the Appellants from 15th July,<br \/>\n  1973 to 30th April, 1974 subject to certain conditions being<br \/>\n  fulfillled.\n<\/p>\n<p> 10.   None of these facts have been controverter in this<br \/>\n  Court either by  the MCD or by the NCT of Delhi.   On  the<br \/>\n  contrary, our attention has been drawn to an affidavit dated<br \/>\n  23rdApril,1998  filed  by the  MCD  in  CW  No.5564\/1997<br \/>\n  (Parents  Teachers  Association  of Shri  Sanatan Dharam<br \/>\n  Lajwanti  Adarsh Vidyalaya v. Lt. Governor of Delhi &amp; Ors.).<br \/>\n  In  this  affidavit, it is stated, inter alia, by Shri  B.C.<br \/>\n  Narula,  Deputy  Education  Officer (Grants) of the  MCD  as<br \/>\n  follows:-\n<\/p>\n<p>    &#8220;At the  outset, I state that  at this<br \/>\n    stage Answering Respondent is filing the<br \/>\n    short Affidavit and reserve its right to<br \/>\n    file Affidavit in detail should the need<br \/>\n    so arise.\n<\/p>\n<p>     1. That recognition  to  the Shri<br \/>\n    Sanathan Dharam   Lajwanti   Adarsh<br \/>\n    Vidhyalaya AshokNagar, Delhi was<br \/>\n    accorded  without grant in aid initially<br \/>\n    for the period w.e.f.  1\/5\/72 to 30\/4\/73<br \/>\n    under   the terms and  conditions  of<br \/>\n    Municipal  Corporation of Delhi.  A copy<br \/>\n    of and  the   recognition letter  is<br \/>\n    enclosed herewith as Annexure-R-1.\n<\/p>\n<p>  That  recognition with grant in aid<br \/>\n    to Shri Sanathan Dharam Lajwanti Adarsh<br \/>\n    Vidhyalaya, Ashok Nagar, Delhi was<br \/>\n    accorded from 15\/7\/73 to 30\/4\/74, on the<br \/>\n    usual terms and conditions.\n<\/p>\n<p>  That again recognition with aid was<br \/>\n    granted  from  1\/5\/73 to  30\/4\/74. The<br \/>\n    Extension  with recognition with aid was<br \/>\n    granted  on yearly basis  till  30\/4\/83<br \/>\n    and,  regular recognition with grant  in<br \/>\n    aid was  accorded w.e.f.  1\/5\/85  under<br \/>\n    the following terms and conditions:-\n<\/p>\n<p>     (a) to (c) xxx xxx xxx&#8221;\n<\/p>\n<p>   11.   In addition to the documents mentioned above, which<br \/>\n  show that the school is a recognised one, we may also refer<br \/>\n  to  a few  provisions  of   the  Act which indicate  that<br \/>\n  Respondents  No.1  to 17 are fully entitled to  there lief<br \/>\n  claimed by them.\n<\/p>\n<p>   12.   Section  2(j)  of  the  Act defines an  &#8220;existing<br \/>\n  school&#8221;  as a recognised private school in existence at  the<br \/>\n  commencement of  the Act.  Section 2(u) defines a  &#8220;school&#8221;<br \/>\n  which includes  a pre-primary, primary, middle  and higher<br \/>\n  secondary  school.   Section4(6)  of   the Act  reads  as<br \/>\n  follows:-\n<\/p>\n<p>     &#8220;4. Recognition of schools &#8211;\n<\/p>\n<p>     (1) to (5) xxx xxx xxx  <\/p>\n<p>     (6) Every existing   school  shall  be<br \/>\n    deemed  to have been  recognised  under<br \/>\n    this section and shall be subject to the<br \/>\n    provisions of  this Act and  the  rules<br \/>\n    made there under:\n<\/p>\n<p>      Provided that where any such school does<br \/>\n    not  satisfy  any of  the  conditions<br \/>\n    specified  in the proviso to sub-section<br \/>\n    (1),   the prescribed   authority may<br \/>\n    require  the  school  to  satisfy such<br \/>\n    conditions and such other conditions as<br \/>\n    may be  prescribed, within a  specified<br \/>\n    period  and if any such condition is not<br \/>\n    satisfied, recognition may be withdrawn<br \/>\n    from such school.\n<\/p>\n<p>     (7) &amp; (8) xxx xxx xxx&#8221;\n<\/p>\n<p>   13.   The Nursery Wing  of  the school run  by   the<br \/>\n  Appellants was in existence prior to the commencement of the<br \/>\n  Act. It  was also recognised by the concerned  authority,<br \/>\n  namely,  the Education Committee\/Education Department of the<br \/>\n  MCD. Keeping  these facts in mind, it is clear on  a  bare<br \/>\n  reading  of  the provisions mentioned above that  since  the<br \/>\n  school  run  by  the Appellants was an  existing  recognised<br \/>\n  school,  it  was subject to the provisions of the Act which<br \/>\n  were fully applicable to the school run by the  Appellants.<br \/>\n  This would  sufficiently answer the legal question that  is<br \/>\n  raised  before us.  We, therefore, hold that at the relevant<br \/>\n  time the  Nursery Wing of the school run by the  Appellants<br \/>\n  was  duly  recognised and subject to the provisions  of  the<br \/>\n  Act.\n<\/p>\n<p> 14.   Learned  counsel  for  Respondents No.1 to  17 then<br \/>\n  placed  reliance  on Section 10 of the Act which  reads  as<br \/>\n  follows:-\n<\/p>\n<p>      &#8220;10.   Salaries  of employees &#8211; (1) The<br \/>\n    scales  of pay and allowances,  medical<br \/>\n    facilities, pension, gratuity, provident<br \/>\n    fund  and  other prescribed benefits  of<br \/>\n    the employees  of a recognised  private<br \/>\n    school  shall not be less than those  of<br \/>\n    the employees  of the   corresponding<br \/>\n    status  in school run by the appropriate<br \/>\n    authority.\n<\/p>\n<p>     Provided  that  where the scales of pay<br \/>\n    and  allowances, medical facilities,<br \/>\n    pension,  gratuity, provident fund and<br \/>\n    other   prescribedbenefits    of the<br \/>\n    employees  of  any recognised  private<br \/>\n    school  are less  than   those  of the<br \/>\n    employees of the corresponding status in<br \/>\n    the schools  run  by  the appropriate<br \/>\n    authority, the   appropriate  authority<br \/>\n    shall  direct, in writing, the  managing<br \/>\n    committee  of  such school to bring the<br \/>\n    same  up  to the level of those  of the<br \/>\n    employees of the corresponding status in<br \/>\n    schools   run   by  the appropriate<br \/>\n    authority:\n<\/p>\n<p>      Provided  further  that the failure  to<br \/>\n    comply  with  suchdirection  shall  be<br \/>\n    deemed  to be non-compliance  with the<br \/>\n    conditions for continuing recognition of<br \/>\n    an existing school and the provisions of<br \/>\n    section 4 shall apply accordingly.\n<\/p>\n<p>     (2) The  managing committee  of  every<br \/>\n    aided school shall deposit, every month,<br \/>\n    its share towards pay and allowances,<br \/>\n    medical  facilities, pension,  gratuity,<br \/>\n    provident  fund  and   other  prescribed<br \/>\n    benefits  with the Administrator and the<br \/>\n    Administrator  shall disburse, or  cause<br \/>\n    to be disbursed, within the first week<br \/>\n    of every month, the  salaries and<br \/>\n    allowances to the employees of the aided<br \/>\n    schools.&#8221;\n<\/p>\n<p>   15.   A  plain reading of Section 10 of the Act makes  it<br \/>\n  clear that  the  employees of a recognised  private school<br \/>\n  shall be  entitled  to at least the same scale of  pay  and<br \/>\n  allowances which are granted to employees of a school having<br \/>\n  a corresponding status.  The facts of the present case fully<br \/>\n  come with in the four corners of Sections 2(j),  2(u),  and<br \/>\n  4(6)of  the Act  as already held by us.   The  rights  of<br \/>\n  Respondents  No.1 to 17 would be clearly governed by Section<br \/>\n  10  of  the Act.  Consequently, we are of the view that  the<br \/>\n  learned Single Judge was right in granting the relief prayed<br \/>\n  for by Respondents No.1 to 17.\n<\/p>\n<p>   16.   Under  the circumstances, we have no hesitation  in<br \/>\n  rejecting  the appeal.  The same is, accordingly,  dismissed<br \/>\n  but with no order as to costs.\n<\/p>\n<p>   17.
